'Beliefs and commitments' of nation's leader should supersede judges - The interpretation of federal law should be made not by judges but by the beliefs and commitments of the U.S. president and those around him, according to President Obama's newly confirmed regulatory czar, Cass Sunstein. "There is no reason to believe that in the face of statutory ambiguity, the meaning of federal law should be settled by the inclinations and predispositions of federal judges. The outcome should instead depend on the commitments and beliefs of the President and those who operate under him," argued Sunstein.
This statement was the central thesis of Sunstein's 2006 Yale Law School paper, "Beyond Marbury: The Executive's Power to Say What the Law Is." The paper, in which he argues the president and his advisers should be the ones to interpret federal laws, was obtained and reviewed by WND. Sunstein debated the precedent-setting 1803 case, Marbury v. Madison, which determined it is "emphatically the province and duty of the judicial department to say what the law is." He lamented multiple recent examples of U.S. presidents interpreting law only to have their interpretations overturned by the Supreme Court.

Ebonics???
Sunstein wants a dictator.
The guy’s a bloomin’ fruitcake of the first order. He’s rubber room material.
Hey nothing at all to worry about. Just another Czar that only has to answer to the President.
This is consistent with appointing all these “czars”.
Obama, like Saddam Hussein, is establishing a shadow government that has little or no accountability to other branches of government.
No wonder Obama wanted him....he thinks POTUS is King of the Universe.
Huh? Did he inform Bush of this?
The Constitution did set up three branches, with separation of powers, but Czar Sunstein doesn’t give a hoot about the Constitution. Then again, neither do the Senators who voted to confirm him.
“He looks like a creep, but even worse, like a ghoul, like some villain from some horror movie.”
- I always thought he bore a strong resemblance to Grand Moff Tarkin of Star Wars (”I think its time we demonstrated the full power of this station”).
The Czars are only the first level of his new dictatorial takeover. Wont be long now, since he has to do all of it before the cavalry arrives next year.
Cass h*** is only the logical extension of Bubba’s:
“Pretty Cool huh? Stroke of the pen, Law of the land.”
We’ve tolerated the Presidential Abuse of Executive Orders from Prez after Prez.
It’s time to put a stop to Executive Orders from the Oval Office, for All Future Occupants except in a time of Congressionally declared war.
Yep, good call he does resemble Grand Moff Tarkin.
Cleary, Sunstein appears Evil. He cannot hide what’s inside of him.
I truly believe that 0bama only has total whack jobs lie this there for one and only one reason, to incite/bait such anger that another whack job will respond and do something drastic.
The HE, that Almighty 0bama, can then enact Martial law for our own welfare.
The he will take the mantle of El Bamadente for life and suspend many, many things that we hold dear.
But what about that pesky Constitution?
Ya gotta be freakin’ kidding me !!!
What a Jackass (to quote our divine leader) ...
I suppose under his reasoning - Nixon had a right NOT to release the tapes ...
Constitutional scholars might argue that the power of Judical Review belongs ‘to the States, or the People’ rather than the Supreme Court.
But never in a million years can there be a case for the Executive Branch - or the Legislative Branch for that matter - to get its mitts on this power.
Sunstein is asking for nothing less than the destruction of the Constitution.
“Gosh, I was sure the Constitution set up three branches, with separation of powers.”
Silly you..
One of the things I've been harping on lately is that truly, the Framers FAILED when they drafted the Constitution. There were certain ill-advised phrases, that the anti-feds warned about at the time--General Welfare, Necessary and Proper, Interstate Commerce. But there was also the failure to spell out, in clear terms, who settles questions of Constitutional interpretation.
It's gotten to the point where conservatives gushing over the Framers makes me want to hurl. Sure, it was a valiant effort. But the results are in. EPIC FAIL.
Don’t you remember GWB’s signing statements?
