Irving's home is repossessed as libel debts mount

David Irving, the disgraced historian who was bankrupted after being branded a Holocaust denier in a failed libel action, has had his home repossessed and his personal possessions seized.

The historian's Mayfair flat, which is believed to be worth around £750,000, was seized by his bank two weeks ago while he was in the United States because of mounting mortgage arrears. It has now been put up for sale.

David Irving in his London home before its repossession In a separate move, bailiffs acting for the libel case victors, who are owed almost £2.5 million in costs, have also seized Mr Irving's personal belongings from the flat, including furniture, computer disks and research papers.

Mr Irving has been in dire financial straits since he lost his high-profile libel action against Professor Deborah Lipstadt, an American academic who said he denied the Holocaust in her 1994 book Denying the Holocaust: The Growing Assault on Truth and Memory.

Mr Irving claimed that Professor Lipstadt's description of him as a man prepared to bend historical evidence, "until it conforms with his ideological leanings and political agenda", was damaging to his career. He sued the American academic and Penguin, her publisher.

However, Mr Justice Gray ruled that Irving was "an active Holocaust denier, anti-Semitic and racist" who had "distorted historical data to suit his own ideological agenda." He ordered the author to meet the entire costs of the case - some £2.5 million.

In March, the historian was declared bankrupt after he failed to make a £100,000 downpayment towards the costs.

The decision by Bradford and Bingley to repossess the house related to arrears on the mortgage. The Telegraph has learned, however, that Baker Tilly, the accountancy firm which is acting on behalf of Professor Lipstadt and her publishers, will seek to claim any equity that has been realised in the property.

The firm instructed bailiffs to seize the contents of the flat on hearing it was up for sale. It is hoping to sell Mr Irving's possessions at auction.

Mr Irving, who is staying with friends in America, said that he had known repossession was a possibility but had hoped to challenge any such move.

He told The Telegraph: "I am still coming to terms with losing the house which was my home for 34 years. I had hoped to hold on to it and did not think they would seek possession while I was out of the country. The bailiffs have also removed my personal belongings, including papers, computers and books. It's having a serious impact on my ability to work and it has severely disrupted my operations in the UK."

Professor Lipstadt last night told The Telegraph she took no pleasure in the news that Mr Irving had lost his home. She said: "This is not something I can gloat about. It is Penguin who are pushing for the money, not myself. I can understand their reasons. They feel that if they don't recover the money they are owed on this case than they would open themselves up to all sorts of similar actions.

"The case brought by Mr Irving and the subsequent appeal has cost me more than £1 million. I doubt whether I will ever get any of that money back."

Lord Janner, the chairman of the Holocaust Education Trust, said: "I am pleased that justice has caught up with him. He deserves everything he gets."

A real historian would have been warned off by the outcome of Oscar Wilde (plaintiff), v. John Douglas Sholto, 9th Marquess of Queensberry (defendant).

Since Mr. Irving started the suit, I feel little pity.

Funny isn't it that in England they actually go after the loser in a civil case, yet here in the US, OJ managed to dodge much of his payment.

I can provide more info if you need it. I find it fascinating that apparently the defense found it necessary in this trial to prove that Jews were actually exterminated at Auschwitz. It only shows how far we have fallen as a civilization.

Thank you very much. I will go and buy this book as soon as I can.

Having read some of his earlier histories, I was deeply impressed by the man's apparant love of the truth. As I recall from transcript excerpts from the trial, the greatest point of controversy was the dispute over the gas chambers, the introductions of Cyclon B through special vents in the roof, that were never located, and the still controversial question of where the bodies went, how such a volume of human remains could have so thoroughly disappeared, etc.

If Irving is claiming these days that the Holocost did not indeed happen, he has indeed gone thoroughly round the bend.

His opponant did indeed accuse him of being a Nazi based on his inability to find references to the exterminations in his research into what Hitler knew and when he knew it etc, but he was very foolish indeed to have sued her for this slander in England, where their libel laws have teeth that can grind a person up and ruin them forever.

Hitler's War was an impressive document, IMHO, although no American publisher had the guts to publish it. Nowhere in it was there anything that would cause one to think that Irving was anti-semitic, much less a Nazi or Holocost denier or anything like that.

There are a lot of outright lies on this issue and honorable people who question the six million number who are not anti-Semitic or anything like it. There were six million Jews in Europe before the war by the count of Jewish scholars of that period themselves. Most of the Jews of Europe got out before the war. Nowhere in the last years have I ever heard any reference to the five and a half million non-Jews who were also exterminated, but that figure alone can get you into hot water as being anti-Semitic.

It is a fact that the Germans slaughtered two million Poles before they actually got started on the Jews, according to Goldhagen in his book Hitler's Willing Executioners.

But regardless of where and by what means, anyone who denies that the Jews were slaughtered by the millions is guilty of wilful lying or wilful ignorance, no matter what.

I'd personally like to see somebody mention, just once in a while, the 20-30 millions of Ukranians, etc. murdered by Stalin before and during the war, and of course the forty plus Chinese wilfully murdered by Mao before and during the cultural revolution, etc.

But the Left don't like the fact that Bolshivism, in all its different forms, murdered at least a hundred million souls during the 20th century. You have to special order any books dealing with this since it's considered the sign of a Fascist to even note these facts.

You're welcome, and you're absolutely correct that Hitler killed a lot of people in addition to Jews, and that Stalin killed millions as well. The twentieth century was pretty deadly, wasn't it? Unfortunately, this century isn't looking real good either.

So if some historian estimates that the number of Jews slain were in the tens of thousands, or even hundreds of thousands, but not millions, then he is automatically evil and untrustworthy in your opinion?

If anyone has any doubts, they should ask the American soldiers who helped liberate the camps. Many STILL have nightmares.

While I feel bad for any writer who has his papers and pc disks seized, Irving started the suit, deserved to lose, and got his comeuppance.

Not only is the man a liar, in denying the Holocaust ever happened, but a coward and a hypocrite, to boot. I've seen film footage of him addressing, in German, adoring neo-Nazis (I am a German speaker). I've also seen film of him saying, in English, in a different venue, that the Jews have suffered so much through the years, that they should consider that their having caused the whole world to hate them must be based on some moral failing of theirs. But the whole context of the foregoing statement was that the Holocaust DID happen. What sense would it make to say, 'The Holocaust never happened, and the Jews brought it on themselves'?

If man is the courageous truth-teller he fancies himself to be, why does he speak with a forked-tongue?
