BREAKING: Judge throws out 1 of 9 charges against shoe bomber

Fox News breaking with the dismissal of 1 out of 9 charges against Richard Reid, alleged shoe bomber for failure to conform to Congress's new anti-terrorism law. I believe I heard that the charge was "attempting to wreck a passenger vehicle."..Still developing.

Did anyone else catch more of the story?

You're right...only 1 out of 9, but I could have really peeved the sidebar monitors by titling it with Fox's breaking news title,"Judge Throws Out Charge Against Shoe Bomber." I had to stop and remember that there were lots of charges against him, they left the implication of only one.

Richard Reid and Pancho Alqaida represent the new wave of Islamic fundamentalist terrorists. Non-Middle Eastern citizens (i.e. UK or US) who will more easily slip past defenses and commit horrendous acts against countries they are supposed to be allied to.

I wonder why they don't charge Reid with participation in the 9/11 conspiracy, consolidate his case with Moussaoui's, and move him to the Eastern District of Virginia. I take it this decision was made by a federal judge in Massachusetts?

BOSTON  — A federal judge on Tuesday threw out one of nine charges against a man accused of attempting to blow up a jetliner using a bomb hidden in his shoes, ruling his conduct did not fall under a new anti-terrorism law passed by Congress after Sept. 11.

Richard C. Reid is accused of trying to kill 197 passengers and crew members aboard American Airlines Flight 63 from Paris to Miami three days before Christmas.

One of the charges against him — attempting to wreck a mass transportation vehicle — was filed under the USA Patriot Act, a new anti-terrorism law passed by Congress after the Sept. 11 terrorist attacks.

Reid's lawyers argued that an airplane was not a mass transportation vehicle as defined by the new law.

U.S. District Judge William Young agreed in part, ruling that although an airplane was engaged in "mass transportation" it is not a "vehicle" as defined by the new law. The judge said the new law does not define the word vehicle.

"Reid's motion to dismiss (the charge) is allowed because Reid's alleged actions are not within the scope of conduct prohibited by (the USA Patriot Act)," Young wrote.

Young said he looked to a legal definition of "vehicle" drafted by Congress, which says that a vehicle is something used as a means of transportation on land.

"It is not a 'vehicle' as that word is used by Congress," the judge wrote in his 24-page decision.

A spokeswoman for U.S. Attorney Michael Sullivan refused to comment on the ruling.

Reid's lawyer, Owen Walker, could not immediately be reached for comment.

The arguments came on the same day that Reid appeared in court for a hearing on his motion to suppress a confession he allegedly made after his arrest. That hearing was scheduled to continue Wednesday.

Not new, just discovered finally. We cannot handle these folk through the Civilian Courts. Military Tribunals are the way. Charge them, then let the Tribunals begin.

Apologies to Native American Indians if I get this out incorrectly, but I was just thinking how Tough and Brave our American Indian peoples were and are compared to these "Cradle of Civilization" cowards and boy fighters...Islamic culture is supposed to be so wonderfull but they are such TERRIBLE warriors!

Anyway...Great Spirit God Bless our Native Americans of all tribes who have shown so much bravery in defending OUR land in this century despite the horrible treatment their ancestors received by some early colonists...Let's ROLL!!!

Found this on Judge Young's bio,

U. S. District Court, District of Massachusetts Nominated by Ronald Reagan on March 8, 1985, to a new seat created by 98 Stat. 333; Confirmed by the Senate on April 3, 1985, and received commission on April 4, 1985. Served as chief judge, 1999-present.

TITLE VIII, Section 1993(c)(5)
the term `mass transportation' has the meaning given to that term in section 5302(a)(7) of title 49, United States Code, except that the term shall include schoolbus, charter, and sightseeing transportation;

49 USC 5302(a)(7)
The term ''mass transportation'' means transportation by a conveyance that provides regular and continuing general or special transportation to the public, but does not include school bus, charter, or sightseeing transportation.
