SAN JOSE, Calif. - Just days after former Santa Clara County Sheriff Laurie Smith retired, she was found guilty of (all) six civil counts of corruption and willful conduct....The trial against the embattled sheriff involved allegations that Smith’s office traded concealed weapons permits for donations to her reelection campaign and mismanaged the jails, where mentally ill inmates died or were injured....Rosen says three other people have already admitted to bribery involving concealed weapons permits. Two other bribery trials for Undersheriff Rick Sung and Capt. James Jensen will start in January.

Republicans lead Rasmussen Reports’ final generic congressional ballot by five points heading into next week’s midterm election. Four days before the election, Republicans lead by five points on the generic ballot, the same generic ballot a GOP candidate has led all year. Of the 2,500 likely voters who responded to the poll, 48 percent said they would vote for the GOP candidate, while only 43 percent said the Democrat candidate.

CNN’s flashy new morning show co-hosted by Don Lemon, Poppy Harlow and Kaitlan Collins bombed in its debut episode on Tuesday. Despite heavy promotion from the network, “CNN This Morning’s” first show drew a mere 387,000 viewers and averaged 71,000 viewers in the advertiser-coveted 25-54 age demographic, according to Nielsen ratings. By comparison, MSNBC’s “Morning Joe” amassed 793,000 viewers head to head from 6 to 9 am ET. Meanwhile, Fox News’ “Fox & Friends” came out on top, averaging nearly 1.5 million viewers.
