German family denied asylum, HSLDA appeals

Tuesday, May 14, 2013

The Sixth Circuit Court of Appeals today upheld the Obama Administration’s denial of asylum granted to the Romeike family.

The Romeikes fled Germany in 2008 when they were subjected to criminal prosecution for homeschooling. They were granted asylum in 2010 by Immigration Judge Lawrence O. Burman, but that grant was overturned by the Board of Immigration Appeals in 2012. A three-judge panel of the Sixth Circuit heard the Romeikes’ appeal on April 23 in Cincinnati, and issued today’s unanimous decision against the family.

“We believe the Sixth Circuit is wrong and we will appeal their decision,” said Michael Farris, HSLDA Founder and Chairman. “America has room for this family and we will do everything we can to help them.”

The court said that the Romeikes had not made a sufficient case and that the United States has not opened its doors to every victim of unfair treatment. Although the court acknowledged that the U.S. Constitution recognizes the rights of parents to direct the education and upbringing of their children, it refused to concede that the harsh treatment of religiously and philosophically motivated homeschoolers in Germany amounts to persecution within our laws on asylum.

“While we will continue to fight in the courts over the issue of whether our law requires the Administration to give this family asylum, there is no doubt of the ability of the Obama Administration to use its discretion to immediately grant this family permanent asylum. We urge the Administration to do so at once,” Farris added.

“If our Administration is willing to explore a policy of leniency for millions of immigrants, it is simply inexplicable why they cannot find room for one homeschooling family from Germany,” Farris continued.

“Germany continues to persecute homeschoolers,” said Mike Donnelly, HSLDA Director of International Affairs. “The court ignored mountains of evidence that homeschoolers are harshly fined and that custody of their children is gravely threatened—something most people would call persecution. This is what the Romeikes will suffer if they are sent back to Germany.”

Thank you for this ping. We should all contribute a little to HSLDA --- I'm making my measly little donation today. 1,000 X measly would be a lot.

The parental right and obligation to raise one's children and educate them in the faith is one of the absolutely most important rights of all. If the Obamunists can get away with their claim that educating one's children is not a "basic human right," every family--- EVERY family --- in America will suffer --- not just homeschoolers.

Indeed, this case should be dear to every American patriot. By the way, we don’t homeschool, for a number of reasons, ourselves.

When America was America, these people would have been welcomed with open arms and those who invade America for freebies and handouts subsidized by the American taxpayers would have been thrown out on their asses.

Obama’s aunt and uncle got asylum.

Millions of illegal aliens have defacto asylum.

Let’s see what happens to this family. Given our history, they need only to overstay their visas.

You don’t suppose this could be related to the IRS harassment of conservatives, do you?

I think it’s part and parcel of the same pattern of behavior in this administration.

It’s a travesty that this family is not welcomed here while the DOJ looks the other way while millions of illegals are here murdering, raping, and committing countless other crimes. Citizenship is granted to terrorists and murderers like Tsarnaev who taxpaying citizens have to support on welfare.

I'd like to know what "reasonable fear or persecution" the Tsarnaevs had. The Romeikes's is simple: in Germany they are in violation of German laws and risk that their children be taken away from them. If that is not reasonable fear, I don't know what is.

In Tsarnaev’s case it was their home federal government persecuting them for a practice of beheading infidels and running a slave trade. It is a religious and cultural traditions and as far as we have a diversity and all cultures are equal they are worthy of asylum.

As for a German couple they are clearly a dangerous dissidents who violates their children’s rights.

No /s tag needed, it has to be a logic of such a regime.

What kind of lawyer do they have??? This is awful.
Maybe they should contact the Gang of 8 especially Marco Rubio, John Mccain. I’m sure they would demand the govt allow them to acheive their American Dream.
