But since charges were never brought one could also argue that treason did not take place. Absolutely!! There were no charges brought, because there were no grounds. They held Jeff Davis for two years and WOULD NOT bring him to trial. Why?? Mr. Davis wanted to be tried, but they would not. Again why??? NO GROUNDS!

Chief Justice Salmon Chase agreed with the argument made by Davis' lawyers, that because the 14th Amendment has been ratified, a political punishment for Davis and other like him had been establised by the people; hence, a trial would represent a form of double jeopardy.
