Certainly not to create a consitutional crisis. Certainly not running around bending and twisting the laws of the land and claiming "There is no controlling legal authority".

I have the feeling that if he had done that, he would have set himself up to be a formidable challenger to Bush in '04, instead he's just a big joke, already fully set into a caricature of himself.
