Nice check list. I think you'll find that all eight of your check points are encompassed by this: (Note: valid legality is based on not initiating force on another person. Otherwise the government could -- and often does -- make invalid/bogus laws that in effect initiative force against citizens.)

Scenario: Privately owned business/restaurant/bar wherein the business/property owner allows smoking.

Short and to THE POINT: Did any person initiate force against another person? No. Check and checkmate.

You are obviously confusing a dictatorship vs. a republic.

You are guilty of that which you erroneously accuse another of. That ploy is as old as the Sun, so to speak. The only difference is that cinFLA isn't confused, for he knows his position favors a dictatorship.

Thats a stretch.

If it clears up any confusion. I will state for the record that kids should not smoke, and adults should not smoke either, unless they want to.

It is still a free country after all, despite the safety Nazis best efforts;-)

You seem blissfully unaware that the distinction between a free society and a fascist one is... you guessed it:

In a free society the individual has rights.
In a Fascist society, the state does.

It does not surprise me at all that neurotic, tiny, controlling people are literally intellectually unable to make the distinction.

In a Fascist society, the individual would have no right to assemble, elect representatives and pass laws that they conclude would benefit that society. Take your ignorant argument elsewhere.

Who is advocating anarchy? No one is saying that the state shouldn't exist. Some are simply saying that the state must not violate the rights of individuals.
