Can't Bush appoint these judges while Congress is out of session? Didn't Clinton do that?

Yes but the appointments must still be confirmed or they last only through the end of the 107th Congress. So effectively they would be out come Jan 3, 2003 or whenever it is the 108th is convened.

I'd love it when, in the next session of Congress, and the Repubs. have re-gained the majority,the Judiciary Committee brings BACK up for consideration, Judges Pickering, Priscilla Owen, and any others that the Democrats rejected this last time!
