Look at Foster v. Love from the United States Supreme Court on the Louisiana system. They allow for run-offs where no candidate gets 50% if the State chooses. In reaching this interpretation, they looked at the legislative history of the enacting federal statute.

What is to prevent successive resignations just before the next election, to continue forever, thus making this senate seat non-elected. If Joe Blow is appointed and serves until 10 days before 2004, then resigns then the Gov. gets to appoint for another two years. It could go on forever. The answer, I belive, is the Constitution trumps these bad state laws.

What has been preventing this is a lack of this much desperation until now ... What will prevent it, should the dems prove themselve so stupid, is a legal challenge to the practice, in a sort of a class action election law RICO case.

The dems are desperate; we all know that. They have created their own desperation by their lust for power as an end in itself, having forogtten why the public entrusted them with power in the first place. I just don't think we realized exactly how desperate till November 2000.

After the crap in Florida last month, this will only be another 'duh' moment in Democratic politics.

With all the approaches to creative, inventive gerrymandering the national democrat party have sported in the last two years, these Senate Dems are now beginning to look like the august body: The Gentlemens Taliban, who, rather than knocking down buildings, slam into pillars of US institutions, one at a time.

If a vacancy shall happen in the representation of this state in the United States senate, it shall be filled at the general election next succeeding the happening thereof,

I read this as though the vacancy will be filled at the next succeeding election, Nov 5 2002.

The GOP should fight this NJ flip-flop tooth and nail and use this incident to energize the conservative base to come out in force in the upcoming November elections. No more of the limp-wristed approach advocated by RINOs who have hijacked the GOP.

I heard on FNC that while Hitlery has all those fund raisers at her home, that the people meet in a large tent in the back yard.

There are two very darn good reasons for it. One, which we know is every hostess's worst nightmare and fear, she can't have people escaping from the party to rummage through her papers, and Two, she isn't about to let the cattle spill cheap wine and chip dip on her furniture (she serves cheap hors d'oeuvres, not real food, at these splendid events).

Sources say that Torricelli is considering not just withdrawing from the race, but resigning from the Senate if that is what it takes to get a replacement on the ballot.

I think the missing link is that these documents indicate the Torch has some unreported income and will be getting a visit soon by add'l federal authorities.

I've been reading all these replies trying to figure out what crime is about to surface that is driving Torricelli and his Senate bum compatriots to such a foolish series of steps. They are confused and floundering - in public - to an astonishing degree, even for dems. IOW, I agree; he knows that something brown and awfully smelly is about to hit Ze Rotary Oscillator.

Torricelli has already taken this to court to have his name removed. The GOP will have to finish it now. Appearances be damned this is a fight to win, again!

I will hold my judgement on McGreevy, his statements during the press conference, led me to believe he had much to do in this in telling Torch to make the moves now, knowing all that's coming out.

Bill/Hill/Mcauliffe have some pull but they're not God. Just think they are in their delusional states of mind.
