I disagree. After the crap in Florida last month, this will only be another 'duh' moment in Democratic politics. And if it is spun correctly, will be tied to a last ditch effort to gain seats- which ain't gonna happen. The dems are desperate, and by pursuing this to the extent they did in Florida, they only make themselves look like the fools they truly are.

BTW, I told kristinn this already, but I heard on Fox today that Hillary will be opening her house to the public -- for a price.

Maybe we should have a fund raiser so you guys can go....I'd REALLY like to know what's in that house!

The national media will protect the Democrats and will spin this to make the Republicans look bad. No matter what the Republican response is, the press will play the Democratic spin in a positive way.

Don't ever forget the role of the Press in a Democratic fraud. When the Democrats pull a fast one the press is always there to help.

They control the state SC. It's one of the most liberal in the country.

Its not a state issue. The senate seat is a federal office. The election is a federal election and it takes place according to federal laws. Proper court is Federal Court.

Only way I can see Democrats retaining the Senate seat is to 1)run a write-in candidate for whoever they can get to run or 2) keep Torch from resigning January 3, keep his name on the ballot and annonce that he will resign, then say who the governor will replace him with (ala Carnahan). Even that second alternative may not be legal. I cant see how changing the ballot at this point would be legal.

I guess this is different than Florida 2000 in that in Florida, they were electing state electors to the electoral college, not the president himself. In this case, they are electing a federal officeholder.

It's one of two things:

"A bait and switch nomination" - the Dems run one person then switch to some other candidate, which if done by ANY corporation would have Ralph Nader on them like stink on crap.

"Retaining power by cancelling an election" because the Dems are in a desperate situation.

And they expect people to vote for them?

No f---ing way. The senate term is six years, not one day more. Thats according to the constitution. Torch can quit any time he wants and the governor maybe able to replace him but ONLY for his term. The replacement is dead meat on Jan 3, 2003.

            You have asked for an analysis of New Jersey ballot statutes and regulations regarding a possible vacancy in connection with the upcoming election in New Jersey.  New Jersey law explicitly provides that when a vacancy occurs among primary nominees, the state committee of a political party committee may select a replacement candidate.  N.J. Stat. § 19:13-20.  However, this ballot replacement is only allowed when the vacancy occurs more than 51 days prior to the election.  Id.  Inside of this 51 day statutory window, a replacement candidate can not be put on the ballot.  The only exception ever recognized by a New Jersey court was in the case of the death of a nominee.  Petition of Koegh-Dwyer, 106 N.J. Super. 567, 256 A.2d 314 (1969), affirmed 54 N.J. 523, 257 A.2d 697.  It is worth noting that the time limit was raised from 34 days to 51 days in 1985.  Legislative history from the original statute states that time limit was included "to afford election official sufficient time in which to attend mechanics of preparing for general election."  Kilmurray v. Gilfert, 10 N.J. 435, 91 A.2d 865 (1952).

Sean Hannity just said that he is stepping down and his conference will appoint a person to run.

Shades of Missouri. If Carnahan loses in Nov. to Jim Talent he can take office right away and not wait until January. The Dims are planning on blocking him from taking office until January.

So it's ok for them to block someone but they will scream bloody murder if the Republicans try to block them.

What's interesting to me about what is happening now is that media bias is blinding them to how these stories look. Like Judy Woodruff calling the Democrats the "peace" party - she doesn't get it because she assumes a majority of people agree with her that's good not bad. So what looks like cynical manipulation to most people will look good to the press - keeping the Senate Democrat is good not bad and if torching the Torch does that, its a good thing. I think they'll be pretty straight about reporting this story.

WASHINGTON — Suffering from an ethics controversy that maintained traction all summer long, New Jersey Sen. Bob Torricelli is planning on dropping out of his re-election race, a Democratic Party source said Monday.

State and national Democratic leaders met with the freshman senator Sunday night to negotiate an end to his re-election campaign, a source close to Torricelli told Fox News.

On Monday, Torricelli also notified Senate Majority Leader Tom Daschle, Senate Majority Whip Harry Reid, Democratic Senatorial Campaign Committee Chairwoman Patty Murray and New Jersey Gov. James McGreevey that he was planning on withdrawing, another source said.

The advice to Torricelli was to "take a long, deep breath.  Don't do anything.  We'll get back to you," the source said.

But sources said after extensive discussions about a possible replacement, Torricelli was expected to make an official announcement during a press conference late Monday afternoon. Torricelli campaign manager Ken Snyder declined to comment.

Torricelli was "severely admonished" over the summer by the Senate ethics committee, which investigated allegations that he had accepted campaign gifts from a campaign contributor, businessman David Chang.

Chang is serving 18 months in prison after pleading guilty to making illegal campaign contributions. During his court case, he told investigators that he gave the senator Italian suits and a $8,100 Rolex watch, among other gifts, in return for Torricelli's intervention in business deals in North and South Korea.

After the Senate admonition, Torricelli apologized to voters, but his Republican rival, Doug Forrester, has capitalized on the issue.

A Star-Ledger/Eagleton-Rutgers poll issued this weekend had Torricelli down 14 points, 47-33, taken before Friday's release of documents used in Chang's court case.

The documents, which Torricelli had hoped to keep sealed until his appeal -- after the November election -- revealed Chang said that Torricelli would call him up whenever he needed spending money. Chang would comply with $2,000 installments of cash, the papers state.

Torricelli said that Chang's claims are uncorroborated and he is an unreliable source.

"After all the sensational and false allegations about many of these gifts, it remains that there was never a watch, suits or any of these other items which I was falsely accused," Torricelli said Thursday. "It just never happened and it's time for people to accept."

The documents were released after five news agencies asked for them to be unsealed, citing their newsworthiness and the fact that they are public record.

The Democrats are trying to maintain a majority in the Senate, which they hold by one seat, and Torricelli's loss would be a big setback to that goal.

However, finding a replacement candidate may not be so easy. With only 36 days to the November election, the deadline for candidates to file has passed.

Democrats posit that New Jersey law allows that if a candidate resigns or dies with more than 30 days to the election, the governor can appoint a new candidate. If the death or resignation happens with less than 30 days before the election, the race can be canceled and the governor can set a new date for a special election.

However, Republicans wanting to keep Torricelli on the ballot say New Jersey elections law prohibits a swap of candidate names within 51 days of the election. Therefore, Torricelli's departure would be a forfeit.

Sources say that Torricelli is considering not just withdrawing from the race, but resigning from the Senate if that is what it takes to get a replacement on the ballot.

Democrats are now looking for potential replacements. Some front-runners named to take Torricelli's place on the ballot include Rep. Frank Pallone, who is said to already have had discussions with Reid and Corzine as long as a week ago, and Sen. Frank Lautenberg, who retired in 2000 and has had a long-standing rift with Torricelli. Democratic Sen. John Corzine won his seat.

Another name is Rep. Bob Menendez, who is a popular Hispanic representative but who is also the number five Democrat in the House Democratic leadership and said to be happy with his stature.

Why isn't Daschle taking heat from the Dims for this? The Senate Dims cynically censured the Torch but did not eject him because they didn't want to take the chance of losing their majority. But if they'd done the right thing the Torch's replacement would probably have been another Dim, Jersey being a Dim state with a Dim governor. Because of Daschle's bad strategy the Dims are now between a rock and a hard place.
