Re prejudice...

Like 'bias' I think that the negative connotation has been allowed to attach itself over years.

Simply a 'predilection' toward or away from anything means a tendancy, maybe a closed mind, it does not mean what we have come to understand it as being: opposition or 'hate'.

However, in common use it is a negative, which leads me to ask...if I cannot exercise a bias in making decisions, what good is experience?

Oh, to return to the subject at hand, Newdow is a creep and he has used the court system as a bludgeon against both his non-family and the larger society. He has weakened the system and should be punished by the system for wasting it's time and confusing it's fabric. Maybe the ninth circuit court should be made to defend him in front of the Supremes?

Here's a thread about another outrage by Judge Reinhardt: JUDICIAL HYPERACTIVISM (JUDGE REINHARDT ABOUT TO STRIKE AGAIN?).

It's no mystery the Ninth Circuit didn't inquire too much into the issue of standing. Judge Reinhardt is going out of his way to reach the decisions he wants.
