Doesn't matter in the least bit - what doomed his case at the appeals level is the announcement by the mother that both her and her daughter are practicing Christians and specifically that his daughter is not harmed by reciting "under God" in the pledge.
The mother has stated her daughter not only recites the pledge willingly she also was upset at the prospect of having the pledge removed. In the fathers suit, he claimed his daughter was harmed by being "forced" to listen to the pledge in school - now that there appears to be no such harm, the suit has no merit and must be thrown out.
Don't get too excited though, i'm positive there is an atheist waiting in the wings with a brainwashed 7 year old who will claim to be harmed by the phrase.

Thank you for your answer. I appreciate it. I'm sure you're also right about some nut waiting to take up the cause.

There was a guy in the Chicago area who was on a similar campaign. He was responsible for having the Nativity scene removed from the city hall in his town, didn't want IN GOD WE TRUST on our currency, etc. He also claimed psychological damage to his child.

This is so typical of liberals, otherwise known as lying sacks of manure!! They constantly lie to the public, and justify their lies because they "care" about "the children" and therefore their lies are justified.LOL, I hope this Clymer Jewish doctor is terrified to show his face in public anymore.
