I believe in a fairly high probability that DAW had an alcohol problem, and commited it in a full blackout. Evidence for alcohol problem:
1. DUI 1996
2. Susan L. left him over drinking in 2002 (alcoholism gets worse in six years)
3. Not remembering the drive home from Dad's-truthful
4. My synthesis of these facts

I don't think so. Voluntary intoxication is not a defense to intentional murder.
Could a drunk in a blackout enter a home they were never in and be so stealthful not to disturb anyone? Driving home, almost a habit, automatic, while blacked out, I could understand. Abducting and killing a girl is another matter.

T.S. How did a DRUNK to the point of BLACKOUT man get into the VD home, kidnap/kill the girl, and get her out without anyone, the dog, Damon, the boys, noticing, and while NOT LEAVING ONE SCRAP of TRACE EVIDENCE.

I have seen Alcohol assessments done on many DWI's that were not found to be alcoholic.
Now he may be an alcooholic..but I would not make that diagnosis till I had all the information..BTW in my experience ..I have seen alot of college ETOH abusers have black outs.....
I think if the DA thought that was posssible he would have followed that premesis...
