Davis Excuse in Pledge Case Proves Outright False
Simon Provides Certified Mail Receipts Showing Davis Ignorance Claims Unfounded

RIVERSIDE - Governor Gray Davis' excuse regarding his failure to entered a defense in the recent Pledge of Allegiance lawsuit has proved outright false, gubernatorial candidate Bill Simon told a gathering of business leaders today.

On Thursday, after Simon blasted the governor for his failure to submit a legal defense on behalf of the state, Davis responded by saying he had not entered a defense because neither he nor Attorney General Bill Lockyer had been notified that the state was a defendant in the lawsuit, and quickly paraded the announcement that he would now submit a defense. But on March 8, 2000, the same day that Michael Newdow filed his court case challenging the Pledge of Allegiance, a summons to appear in court was sent by certified mail to Lockyer at the Department of Justice address advertised on his Web site, records show. The plaintiff, Newdow, filed on March 10, 2000 with the Eastern District Court in Sacramento the receipt of certified mail showing proof of service to Lockyer's office. On April 26, 2000, Newdow filed with the court clerk proof of receipt showing that the attorney general's office had received the service.

"Gray Davis now claims neither he nor his attorney general were served papers about the lawsuit," Simon said in remarks to the Riverside Lincoln Club. "But the U. S. Government, in courthouse documents and through certified mail, tells a different story. The plaintiff of the case is in possession of proof of service, demonstrating that the governor's lawyer, Bill Lockyer, did receive notice. The fact of the matter is that once again our governor is resorting to half-truths and deflection in order to mask his failure to act."

"Gray Davis' failures as governor continue to accumulate with each day he is in office," Simon said. "He failed to act in the energy crisis, in the budget crisis, to prevent offshore oil drilling, on the needs of California veterans, and now it is clear the governor failed to act in defending the Pledge of Allegiance. This list goes on and on. California just cannot afford this kind of failure."

I doubt that we'll see this in any of the California lamestream media, and even if they did cover it, he'll just deny that he knew about it, that it was handled at a lower staff level, blah, blah, blah.

I'm dreading the thought of this pantload as our Governor for another four years, I just wish I could be more optimistic about Simon's chances. Our beautiful state has drastically changed for the worse since the glory days of our beloved Governor Ronald Reagan.

What kind of Mordor-like cesspool must California be for such a failed Governor, failed in every aspect of his administration, to still have to be considered a favorite in the election?

What kind of complete imbeciles must California voters be that an issue that will never matter in that state (pro-life/pro-choice) will still trump in their minds every other single issue, including their own pocketbook and security?

The same kind of imbeciles that we voters here in Washington are, I suppose.

It's great that Simon caught Davis in this blatant lie, but I have a problem with Simon positioning himself to the left on a completely bogus environmental issue.

It's not only bogus, Simon's position on offshore drilling is environmentally destructive. Pumping oil in the Santa Barbara Channel reduces the static pressure of the oil that would otherwise seep to the surface. That oil will now foul the water at an increasing rate, killing birds and intertidal marine life. The Chumash Indians used to seal their fishing boats with the stuff that floated up on the beach.

Too bad he can't seem to get decent help on this issue when it's available free of charge.

Looks like there is a very competent man running for governor. Hope California is bright enough to elect him. They're really going to need someone with brains to help them out of the mess that Davis has made.
