Another case mentioned by wolfowicz was In re Territo, 156 F 2d 142 (9th Cir 1946), which held that a citizen who is an enemy belligerent can be held without trial for the duration of the war (sorry , I can't find any links to more than snippets of it).
Generally, IMO, the view is that nationality doesn't make a difference in POW status- that Padilla shouldn't be treated any better or worse than any other POW.

I'm not against everything Pro-American. If they are keeping the guys lights on 24/7, that sounds kinda of stupid. You could put a night light in there for heavens sakes. mrs.parsifal has one in our bedroom. I wouldn't want my lights on 24/7. parsy.
