Slain girl's father testifies tearfully, fends off lifestyle attack

SAN DIEGO — Raw grief mingled with common titillation at the Danielle van Dam murder trial Wednesday as the slain second-grader’s father took the stand against her accused killer.

Damon van Dam gave a wrenching account of the 7-year-old’s abduction from the safety of her suburban bedroom, but under a relentless cross-examination by a defense lawyer, he bitterly confirmed rumors that he and his wife engaged in swinging, or wife-swapping.

“I have opened my life up — every detail — to try to get my daughter back and now to get justice for her,” a red-faced van Dam said after admitting that he had sexual relations with other women while his wife watched.

Prosecutors are seeking the death penalty against David Westerfield, a 50-year-old engineer who lived two doors from the van Dams. They allege he is a pedophile who snatched her from her canopy bed Feb. 2, raped and suffocated her and then dumped her body along a rural road.

Damon van Dam’s grilling Wednesday, the second day of the trial, appeared to be part of a defense strategy to shift the focus away from strong DNA and other physical evidence against Westerfield and toward Danielle’s parents and their lifestyle.

It was unclear how well that approach played with jurors. As defense lawyer Steven Feldman got van Dam to acknowledge intimate relationships with two female guests in his home the night Danielle disappeared and that a third man present was his marijuana dealer, few jurors took notes. And as van Dam stammered with the uncomfortable questions, jurors stared at the lawyer instead of the witness.

During a sidebar conference between Judge William Mudd and the lawyers, van Dam stared at supporters in the gallery, shook his head and then in full view of the jury, slammed his forehead down on the witness box.

The day of testimony that ended in frustration and shame, began in tears. The software engineer choked with emotion as he showed jurors photographs of Danielle’s room, a young girl’s pink and purple dream. Stopping frequently to regain his composure, he pointed out her toy box and shiny white dresser, the "little fluffy hearts" hanging from her ceiling and her snowy canopy bed and lilac sheets.

"She was in her bed right here with her dollies," van Dam told the panel, describing the last time he saw his daughter. An alternate juror clutched her notebook to her chest and wiped at her eyes.

Van Dam said that on that Friday night, his wife, Brenda, and two friends, identified as Barbara Easton and Denise Kemal, had scheduled a “girl’s night out” at a local bar. During cross-examination, van Dam said he and Kemal had sex in his bed once, a year before, while Kemal’s husband and Brenda van Dam were present. He acknowledged that he and Easton, an airline stewardess, had intercourse once and sexual relations twice. On those two occasions, he said, Brenda van Dam watched.

On Feb. 1, he had agreed to watch Danielle and her brothers, Dylen and Derek. Before the women left, he joined them in smoking a marijuana joint in the garage.

He described the night as typically mundane. He had more pizza and a third beer while playing video games with his sons. Danielle wrote in her journal and read. The dog, Layla, chewed up her bed. Then it was time for sleep. By 10, he said, he had kissed his three children and made sure they were in their separate second-floor bedrooms with their doors open a small crack.

Soon after, he turned in. His wife, Kemal and Easton returned from the bar with two male friends just before two, he said. Easton jumped into his bed and van Dam said he kissed and “snuggled” her for five minutes before joining the other guests downstairs.

He said the guests left within 20 minutes and then he and Brenda went to bed , shutting the dog in their eldest son’s room. They did not, however, check on the children.

Sometime in the three o’clock hour, he said, something woke him up and he noticed that an alarm panel indicated an open door or window somewhere in the house. When he went to investigate, he found the rear sliding door open. He concluded that one of his wife’s friends had opened the door, a conclusion he said he made "quickly and mistakenly."

“Did you check on the kids?” asked Dusek.

“I didn’t check on the kids. I was tired and I didn’t think that door being open was that important at the time,” he said.

The next morning, Brenda van Dam discovered Danielle’s empty bed. Damon van Dam admitted initially lying to investigators about his pot use and his relationship with Easton, but said he told the police the truth when they impressed him with the gravity of the situation.

"I didn’t think it mattered and I didn’t want to get in trouble," he said of the marijuana.

He also gave jurors the layout of the house and seemed to poke a hole in at least one defense theory — that Westerfield, who barely knew the family, would never have been able to navigate a strange house and find Danielle’s room.

Damon van Dam showed jurors photos of the doors to the children’s three rooms. Derek had a Pokemon sticker on his door while Dylen had a Tarzan photo on his. Danielle’s door was decorated with a heart and two flowers, and immediately upon opening the door, her canopy bed was visible.

Judge Mudd warned witnesses and those attending the trial against wearing mementos of Danielle, including button pins showing her picture. Damon van Dam took his off to testify, stuffing it in the front pocket of his white dress shirt. His daughter’s image was visible through the fabric.

Westerfield’s case moved remarkable quickly to trial. Danielle disappeared four months ago and Van Dam still spoke of his daughter in the present tense.

"She’s just learning to spell," he said. Later he described Danielle reading to her brother Dylen, saying, "She likes to help him learn to read."

Also testifying Wednesday was forensic dentist Norman Sperber, who the prosecution called to bolster their theory that Danielle was suffocated. Sperber said Danielle was missing four front upper teeth, including one later found in the back of her mouth.

Sperber said teeth could have been knocked out during an assault, but might also have fallen out as the body decayed. If that was the case, Sperber said, the teeth should have been located at the spot where she was dumped. The teeth were not.

Medical Examiner Brian Blackbourne, who began his testimony late Wednesday afternoon, is to continue on the stand Thursday morning.

I haven't followed this case recently so please forgive the question. Has it been determined by forensic pathologists that Danielle was raped and suffocated? It was my understanding that her body was far too decomposed to make a determination on the possibility of rape.

The "charge" is what's stated. The procecution has to prove it.

SAN DIEGO -- Danielle van Dam's father testified Wednesday that he lied to police at first about smoking marijuana the night before his daughter disappeared, but said he later told officers what they wanted to know.

Damon van Dam also testified that he had engaged in past extramarital intercourse with the same two women who went out with his wife the night before his 7-year-old turned up missing Feb. 2.

"Since realizing the magnitude of the situation, I have opened my private life up, and given every detail possible to try to get my daughter back ... and now to get justice for her," the father said.

His testimony -- tearful at times -- came in the second day of the murder and kidnapping trial of David A. Westerfield, a 50-year-old self-employed design engineer accused of killing the Sabre Springs second-grader.

Nearly from the start, rumors of extramarital sex involving the parents of the child have swirled -- fueling speculation about whether that could have led to her disappearance.

Van Dam, 36, said Barbara Easton and Denise Kemel went with his wife on a "girl's night out" to Dad's Cafe in nearby Poway the night of Feb. 1, because Easton was scheduled to be transferred out of town.

"In fact, (the women) were your intimate friends, isn't that true?" defense attorney Steven Feldman asked.

After a pause, van Dam quietly answered, "Um, yes."

"There had been other occasions prior to the first of February that you were intimate with Barbara Easton?" Feldman asked.

The attorney suggested it had happened twice, which van Dam denied.

"How many times?" Feldman asked.

"Once."

"Where was that?"

"Barbara's house."

The questioning began to annoy the Qualcomm software engineer when he was asked to testify again about some kissing and rubbing with Easton that took place in his bedroom, while his wife was out of view, after the three women got back from Dad's Cafe.

"And Barbara was a person with whom you'd been intimate with previously?" Feldman pressed.

"Yes," van Dam said in a drawn-out manner.

Shortly thereafter, Feldman brought up Kemel.

"With regard to Denise, had you had intimate relations?"

"If you mean sex, yes," van Dam said. He told Feldman he had sex with her in front of his wife and Kemel's husband.

The father also testified he initially didn't tell authorities he had taken "a puff or two" from a marijuana cigarette the women were smoking the evening before Danielle turned up missing.

"I didn't think it mattered," he said, "and I didn't want to get in trouble (for that)."

But van Dam said that after the officers told him they were only interested in finding his daughter, he began to be truthful with them.

"When they told me it was absolutely critical to know what happened that night, I told them everything that happened that night," van Dam said.

Feldman verbally hammered at van Dam regarding his initial lack of candor, asking him about specific statements made to specific police officers in the hours after his daughter was reported missing.

Van Dam was able to recall general questions and answers, but few specifics.

Feldman was able to get van Dam to say he did not take notice whether any lights were illuminated on his home security system, meaning a window or door was open, before the women returned.

When he woke up about two hours later, he said he did see such a light. He testified he found a sliding glass door open, and also checked a door in the garage.

Much of the early testimony was designed to orient jurors to the layout of the van Dam house, using a floor plan and photographs.

Van Dam described the upstairs hallway that led to bedrooms, and also told the jury of six men and six women what was in Danielle's room.

One of the issues in the case is whether artwork posted on the doors of the bedrooms would help someone know which room was hers.

He added that each of the children's rooms had night lights, but Danielle's was burned out, so he opened the drapes to allow street light into the room.

When he was shown a photograph of his daughter's door, van Dam began to cry as he described why a dog gate had been placed there.

"I asked that the room not be cleaned," he finally managed.

Van Dam said he and Brenda "got very nervous very quickly" when they discovered Danielle missing the morning of Feb. 2. He searched outside and noticed their side gate, which is difficult to open, ajar.

Nervous when he took the witness stand, van Dam misstated which grade his oldest son was in.

Dr. Norman "Skip" Sperber, a forensic dentist, testified that four of Danielle's teeth were missing when he examined her mouth, but that he later found one.

Sperber told Deputy District Attorney Jeff Dusek teeth commonly fall out during decomposition, but that none was found under the body after it was discovered Feb. 27 near a tree in Dehesa.

In pretrial motions, the prosecution said the loss of teeth showed Danielle could have been suffocated.

Co-defense counsel Robert Boyce got Sperber to concede that any finding on the missing teeth other than decomposition was basically "pure speculation."

Late in the day, San Diego County Medical Examiner Brian Blackbourne testified that Danielle van Dam's body was so decomposed when it was found that it was impossible to establish a cause of death.

Westerfield, charged with murder, kidnapping, possession of child pornography and the special circumstance of murder during a kidnapping, could get the death penalty if convicted.

Look at that picture of Damon covering his mouth. I read a book on lying, and one of the (several) signs a person is lying is when they speak with their hand covering their mouth.

The night was typically mundane.  Evidently smoking pot and having extra sex partners show up was a typical mundane occurance around the Van Dam house.  What did the children do while the adults were smoking pot?  What do you say to a seven year old girl when she wants to go out to the garage with adults?  Girls are very social and crave being around their mom especially when grown up women come over.  It's a girl thing.  Evidently the Van Dams simply tell the kids to stay out of the garage, or they let them watch.

Here is another curious series of facts.  Van Dam leaves the kid's doors open when they go to bed.  But when he's alone on the bed with the other woman, nobody bothers to close the kid's doors.  Adults are home cavorting around.  The kids have been asleep for five hours.  In all likelyhood they could easily wake up.  But the Van Dams don't seem to care enough to close the doors or to mind if one of the kids walks in on dad while he's stroking someone other than mother.

What does a child think when they find dad kissing a woman other this their mother?  Do they think that it's okay because they've grown up seeing that over and over?

Okay, something wakes you up.  You walk downstairs and check the alarm.  You find a door is open.  You secure it and reset the alarm.  But you don't check on the children.  How long would it take to make a glance at the kids?  Obviously Van Dam cared enough about whatever woke him up that he checked out the house.  Why wouldn't he check on his kids as a matter of procedure?

These people are more interested in their own perverse pleasures than the safety or well being of their children.  I am astounded that parents of other children come to these folks defense so easily.  All the concern seems to be about "their" loss.  Pardon me, but my concern was for the little girl who was placed in harms way and paid the ultimate price.  To hell with the parents.

Danielle's body had missing teeth.  It seems to me it would be easy to tell if those teeth were knocked out or fell out due to decay.  Teeth don't just fall out.  I've witnessed enough dead animals to know that there is breakage if they are knocked out.  What damage was there to her lips?  Did Westerfield have any wounds on his hands?  Did the teeth have damage on the surface from a hard object hitting them?  Were the roots broken?

There's a lot missing here.  This should all come out in the trial.  I can't wait until Brenda is put on the stand.  I'd do my best to corner that woman.  I'd have canvased every bar within thirty miles in order to see if anyone had seen Brenda with Westerfild before.  If she was a consort of his, I sure as hell hope it comes out.

I've been studying Westerfield's driving around that weekend. I can only think of two possibilities:

1. He was just hoping to meet up with some overheated chicks in places he'd had success before, or

2. He was trying to figure out where to dump a body.

If #2, why did he end up dumping her just off a main road? It doesn't make much sense.
