Using this reasoning, the International Criminal Court could prosecute many of the American military personnel who participated in World War II because they fought back against the Germans and Japanese, who initiated the fighting.

If the International Criminal Tribunal is to be used to indulge in Jew-hatred and prosecute anyone leftists hate, it's DOA. Trust the Germans and other Europeans to ressurrect the legacy of the vile Jew-hater Roland Freisler and re-constitute the notorious Nazi "People's Court" in the guise of this foolishness. Ignore their rulings, tell them perpetually that they're impotent, make sure they know that they're illegitimate, and challenge them to enforce the actions of their new "People's Court". Rub their noses in the filth of their new kangeroo court. The Europeans deserve it.

Apparently, in Arabspeak, targeting concentrations of gunmen belonging to organizations that have explicitly declared unrestricted war on you and your people, are actively engaged in the exchange of fire with your forces, have been urged and ordered by their leader to "fight to the death," and have repeatedly refused opportunities and entreaties to surrender, is "indiscriminate".
One wonders what would constitute a "discriminate" attack in Arabspeak. (One suspects the answer is one directed against Jewish women and children.)
