Prosecutors will weigh a number of factors that may lead them to prosecute Andrea Yates husband Russell for either child endangerment or negligent homicide. ABC News has learned.
No decision has been made, but it is being seriously considered, sources said. Prosecutors would charge Russell Yates if an when the evidence warrants, but do not have the evidence now, sources said.
Andrea Yates 37, was convicted Tuesday of two capital murder charges filed in the killings of her children last June.
The REAL ANSWER isn't what she was taking, but the fact that they kept her from killing people WHEN SHE WAS ON IT!!!!! She became a murderous whore when she STOPPED taking the medication! And he husband KNEW she wasn't taking it and WAS WARNED NOT TO TAKE HER OFF OF IT!
As for what evidence the DA needs, man I don't get this one. 5 counts of child endangerment is definately there. He asked for his mothers help. If she was a great mom, why would he have done that? Then I'd lay on emotional cruelty and criminal neglect and child abandonment in the hands of a mentally unstable person. How many manically depressed babysitters do you let watch your children! Russell Yates is the real peice of crap in this whole mess! A classic psochiopath!

In fact 70% of men should be put in prison on general principles. 30% must remain outside--temporarily--so they can rush into collapsing buidings and dig ditches and hold down the outposts of the Empire and so on.
See my post above. Until you live with someone with a severe mental illness, I strongly suggest that you refrain from judgment of those who do.

Traditional? I don't think so. I don't know of any "tradtitional" families who kill their own kids.

Stop shifting the blame. Those of us who have cared for family members who are mentally ill do know what it takes, but we also have to recognize (obviously you do NOT) that when those family members are a danger to themselves or others, we have obligations to protect others, or society as the case may be.
That's the reality.
Russel Yates *knew* what his wife would be capable of doing. He sat by and did NOTHING. He's culpable. Get over it.

So what! Was it your wife? Did you continually impregnate her up after she was diagnosed as mentally ya-ya? We're not talking about your parents or children or siblings or relatives, we are talking about a spouse who only concern in life was to knock up his wife even after being diagnosed as being a manic depressive, and then have her take care of 5 kids, (one being a baby) 24/7 including home-schooling!
You may have an argument of "I took care of a mental person so you don't know what your talking about" argument, but try taking care of 4 boys and a baby when your mentally straight and imagine putting the person you took care of in the same situation. Then tell all of us here Russell Yates isn't culpable!!

Now common sense tells me that if I thought someone was so ill, he/she shouldn't be left alone for any length of time with children....I think there is enough blame to go around for the whole family.

Actually they look for sympathetic saps like you that will blame everything in the world but yourself! I believe that a mans job in life is to take care of his wife and Children. Russell Yates not only did not do that, but compounded the problem, ignored the demons and allowed his children to be murdered. But what the hell do I know.
