The Autopen is not allowed to be used if approval is not specifically given by the President of the United States Rightly or wrongly, Biden already said he approved pardons and commutations. That's it.
No way the Judiciary gets involved, based on what is currently known.

Good. Trump and the Republicans should forcefully shove that stick squarely into that hornet’s nest.
We will no doubt hear them caterwaul as if the devil himself was stepping on their collective tails.
We should remember all those times Biden, his Press Secretary, and the Democrat Party repeatedly came out and said definitively that Biden would NOT submit proactive pardons for all his relatives...until he did. Including the one for the Hunter Biden in December, then one for ALL his relatives and their in-laws only hours before Trump’s inauguration.
Although, to be fair...he did say HE would not issue pardons. And it is true...he didn’t. It was the Autopen.
