I think they are hoping for mootness and the circuit court is hoping it goes that way also. They will drag their feet because they know that the district judge is wrong but they don’t want to be the ones to overrule. They know if they don’t overrule, they will be slapped down by SCOTUS.

Will SCOTUS eventually make a ruling and smack down the federal judge? Or will they delay it long enough so the case can be declared moot and dismissed? Well, I think it will be moot as of Thursday when the government reopens and funding is restored to SNAP with the CR, which is likely why they extended it to Thursday. They would rather not touch the case, and two days isn't going make much of difference either way.

Already moot once funds are released, but the nonsense ruling from the crazy district court judge had to be held up until Shutdown was officially ended and the funds were available.
