Justice Barrett weighs in on Trump third-term talk

Supreme Court Justice Amy Coney Barrett has weighed in on the constitutional viability of a potential third term for President Donald Trump, telling Fox News host Bret Baier that the 22nd Amendment's two-term limit is clear and unambiguous.

When asked if the amendment was "cut and dry," Barrett responded: "Well, you know, that's what the amendment says, right? You know, after FDR had four terms, that's what that amendment says.".....

"Sometimes it's very specific. The president has to be at least 35 years old," she said. "But sometimes it's very general. We're protected from unreasonable searches and seizures. We have freedom of speech. And to have freedom of speech doesn't mean that you have only to pass out pamphlets in a town square. I mean, it means you have freedom to be on broadcast news."

When Baier pivoted to the 22nd Amendment, saying, "And the 22nd Amendment says you can only run for office for two terms," Barrett simply responded: "True."

The 22nd Amendment, ratified in 1951, explicitly states: "No person shall be elected to the office of the President more than twice." This amendment was adopted following Franklin D. Roosevelt's unprecedented four terms in office, establishing a formal limit on presidential tenure that had previously been only a tradition dating all the way back to America's first president, George Washington.

This is very poorly drafted and there are lots of loopholes.

First of all - there are no popular vote Presidential elections in the Constitution. Therefore, "running", "being nominated", "being on the ballot", "votes being counted in a State" all have nothing to do with this Amendment.

The only "electing" in the Constitution happens when the Electors (appointed by State Legislatures) cast their votes on the second Monday in December.

The Amendment does not say no one can vote for a "twice elected" candidate, it just says that person "can't be elected".

i am QUITE sure ACB knows the wording of 22nd A but - it is what is is- but thought better of correcting BB’s phrasing,answering well within the meaning of the amendment.

President is technically elected by the electoral college.
So there were “unfaithful electors “ in the college.
As I understand it, unfaithful electors are not unconstitutional.

Amy only cares about the constitution when it gets her invited to another cocktail party and glowing review in the NYT. She actually thinks liberals will love her when she rules in their favor and ignored the constitution. Sorry, Amy. The liberals and democrats hate you as much as they hate Trump.

I like term limits, if we only had them for Congress. 8-10 years is plenty.

Or, Trump could go the Obama route by installing a puppet successor and then ruling in his/her place. Might even be able to get a 4th term out of it.

Other than the closing sentence of the 12th Amendment, sure:

"But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."

If Democrats wanted to have some fun, they should admit they rigged the 2020 election and that in 2024 Trump was (illegally) elected President for the third time.

The 22cd Amendment states that he can’t run for President.....Not that he can’t serve another term. So, he eligible to be POTUS, just can’t be elected. That’s my take on it.

“Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.”

DeSantis was a disaster of a candidate in 2024 and shouldn't even think about running again.

Few Trump supporters are going to forgive him for siding with the Republican establishment and running against Trump.
