If he is absent the US Senate votes and his probable NO vote doesn’t get counted. The Senate confirms the nominees anyway either 50-52 or 50-50 with JD Vance casting the tie breaker as President of the Senate

Ky pass a law requiring the Gov to pick a candidate from the same party as the retired Senator to fill out his term. 9 other states have the same law
Kentucky changed the rules a few years ago, limiting the appointment power of the governor: Under the amended law, the governor now may only choose from three names recommended by the executive committee of the outgoing senator’s state party, and must make that selection within 21 days of receiving the list from the party.
KY Governor has said he would go to court to fight that law, believing he would win. Given the court system’s bias in favor of liberal activism, he might succeed.

Have we looked into the details here, lately, of how Kentucky fills vacant US Senate seats? I thought I read that the process changed recently per Republican State legislature there, no?
How is the vote 55-54? I thought there were only 100 senators. Or was Obama right that there are 57 states?
