Wanna fix patents? Go back to original time limit for expiration. If you cannot make a profit in that time, tough. Also, forbid extending a patent for one chemical simply by adding another to the pill and renewing the patent. E.g., some drugs add things like aspirin, rename the whole thing, and get another batch of years. OK, the new mixture is patentable — nobody is allowed to simply ALSO add aspirin. But, the base chemical falls out of patent.
That will lower prices tremendously on loads of pills.

Harris’ ‘fair market’ idea is plagiarism of Trump’s ‘most favored nation’ plan proposed via EO in 2020.. The MFN plan was forcasted to reduce prices about 30%.
‘Seizing patents’ is non-sensical. About 80% of the Active Pharmaceutical Ingredients (API) are produced outside the US. And, not all medications are produced within the US; GlaxoSmithKline, for instance, is British.
Also, free-market doesn’t really apply to pharmaceuticals. There is limited competition, the patient isn’t in a position to negotiate with foreign entities and pricing is arbitrary - it doesn’t align with inflation but is a complicated rebate dance between pharm companies and commercial health plans.
Trump proposed that the rebates that pharm companies give to health plans be passed directly to the Medicare consumer instead. However, it was suggested that while drug prices would indeed decrease, cost to the government would increase, resulting in increases to medicare premiums and the ‘donut hole’, in effect reducing any direct benefit from a reduced drug price. The current ‘donut hole’ is $7,000 cash out of pocket annually but Biden’s Inflation Reduction Act will cap total rx costs for Medicare Part D at $2,000 annually starting in 2025 at a cost to the govt of $3B/year. Whether that will translate for commercial policies is yet to be seen. It will be interesting to see how Harris plans on improving the cap, or if she’s even cognizant of its existence.
Federal law already allows for an individual to purchase a 3-month supply of certain drugs from Canada. But not all medications are cheaper. Trelegy inhaler is about $150/mo on Medicare Advantage plans, but it’s $190 from the Canadian pharmacy I use. (ordering 6-months supply at $970 is still $11/mo more than the Medicare pricing). Albuterol inhaler is about $1 on Medicare, but thru Canada is $14. And there are also free drug discount plans such as GoodRx, which offers reduced prices on some drugs. Trump had proposed importing drugs from Canada, except Canada balked, claiming large-amount purchasing by the US from Canada would increase drug costs to Canadians.
It will be interesting to see what Harris will claim is her idea!
