The 3rd Circuit Court of Appeals rejected the argument that refusing to wear face masks at school board meetings during the COVID-19 outbreak constitutes protected speech under the First Amendment.
The court ruled on cases involving individuals who claimed retaliation by school boards for not wearing masks at public meetings.
The court emphasized that disobeying a masking requirement does not fall under protected speech, comparing it to other forms of non-compliance with the law.
The 3rd Circuit Court of Appeals ruled, “A question shadowing suits such as these is whether there is a First Amendment right to refuse to wear a protective mask as required by valid health and safety orders put in place during a recognized public health emergency. Like all courts to address this issue, we conclude there is not,” the court said.
“Skeptics are free to — and did — voice their opposition through multiple means, but disobeying a masking requirement is not one of them. One could not, for example, refuse to pay taxes to express the belief that ‘taxes are theft.’ Nor could one refuse to wear a motorcycle helmet as a symbolic protest against a state law requiring them,” the court continued.

So what should take precedence? Personal responsibility or Government control? Conservatives say personal, libs say government.
Not wearing a mask communicates the fact that mask pores are 160 microns wide and virus particles are 1.3 microns.wide and wearing masks served only to instil fear to help sell a deadly product.

I don’t disagree, it is a personal choice, a lot of the ongoing argument borders on arguing to people who have made a personal choice and denigrating that personal choice.
See somebody wearing a mask and calling them out for wearing a mask when it’s a personal choice it’s either being argumentative or authoritarian over what would you consider to be unacceptable behavior.
As an example. in Japan in the 60s the ‘70s and the eighties and people donned masks (and still do) because they wish to as a preventative measure. And the prevention is for a myriad of things they personally consider to be a hazard to their wellbeing. I’m seeing that here in the states as well.

There’s a very good reason why we don’t hear about nosocomial infections in the news anymore, isn’t there.

Meanwhile, since deaths from medical mistakes in this country run in the six to seven figures annually, I’m wondering if excess mortality might decline because fewer people are being bumped off by Big Med.
Agree, wearing the mask was bad policy and a bad order. However, if you want to engage in free speech, in very large clear letters write on the OUTSIDE of the mask -FJB.
Better yet spell it out for all to see. The words will trigger the sheep and when they complain, ask if they want you to take the mask off.

The answer is to mandate that all officers of the court and judicial officers wear a mask at all time when within 50 feet of another human and entitle any private citizen to damages and sue them in small claims court for any violation that they witnessed

Bull shiite. Will not comply. Those masks were more harm than good. I don’t care if wearing one makes some squishy liberal “feel safe”. It makes me feel unsafe, and causes respiratory issues. Whose rights triumph? I don’t know about anyone else, but I’m not wearing a mask.
You make a good point, but I believe that it supports the scenario that higher excess deaths are jab-centric...i.e., I don’t believe that excess mortality will decline.
But they’ll do their best to spin it, just like the economy & jobs.

The order that was given to wear masks ignored the science and gave the order anyways, making it invalid! Fauci actual.y had it right in the beginning when he said masks would not preven,t the spread of covid as the virus was too small to be stopped by masks. That was the only thing fauci was ever right about. He got lectured for his faux pas and quickly turned to demanding that people wear masks despite the evidence proving they did not work
Nearly everyone who got covid was wearing a mask at the time because of the state rules and regu,atio s concerning masking up in public.
Rather, it is the right to be left the hell alone.
