That’s what I was thinking. If he had of shot him when he was a foot away, then def. 100% self defense and justified.
If the guy said he was going to get a gun or a knife, then justified. If he was retreating, then different story.
I am not an attorney. If by justified, you mean in the informal sense among people such as you and your peers, perhaps, but certainly not in any legal sense. He will be convicted on the first shot alone. He will also be convicted on the second shot. The coup de grace will establish his premeditation and therefore felony murder. NY abolished the death penalty in 2004.
The reference to the killing being "in cold blood" seems off to me. This is a hot-blooded killing. Please correct me anyone!
