I don’t believe it is legally defensible to charge someone with a crime over an attestation of something that is a matter of legal and factual dispute. Otherwise, a person could be charged — after the fact — with perjury, for signing an affidavit disputing the facts in a court case. A defendant in a criminal case who signs an attestation under penalty of perjury as part of a “Not Guilty” plea can’t be charged with perjury after he is convicted.
