They’re absolutely shocked when they find out that Congress repeatedly defunded the NICS database retention to try to end the practice and FBI/DOJ just ignored them. Then Congress threw up their hands, said ‘What can you do?’ and went on to their next set of junkets. So Congress basically has said “We won’t do anything about it being unconstitional.” And of course, suing them ends when you run into sovereign immunity.
