‘Open Carry’ measure now off the table, disappointing Second Amendment advocates

Less than 24 hours after a GOP lawmaker filed an amendment to gun legislation that could potentially allow open carrying of firearms in Florida it has been withdrawn, disappointing Second Amendment advocates.

That leaves the gun legislation, a permitless carry bill, to proceed to a vote before the full Florida House of Representatives later this week.

That bill, HB 543, would repeal the requirement that Floridians who carry a concealed weapon must get a license through the state. It would also mean Floridians would not have to take a gun safety and training course.

Luis Valdes, the state director of Gun Owners of America, told the Phoenix that he was disappointed that the open carry amendment, which his organization has been advocating for, will no longer be considered.

“It comes down to legislative leadership,” Valdes said.

Curiously absent during much of the public discussion about open carry has been Florida Gov. Ron DeSantis, who has said twice publicly when asked that he supports the open carry provision and would sign such a bill into law, if the Legislature sent such a bill to his desk.

That somewhat passive stance has alienated some gun rights advocates like Matt Collins. He told the Senate Fiscal Policy Committee earlier this month that DeSantis looked “impotent” in failing to get GOP leadership to rally behind open carry.

“I like Gov. DeSantis, but quite frankly, the inability to get open carry included in this bill is embarrassing for him,” Collins said. “It’s failed leadership and it’s weak. And finally, it begs the question that if the governor cannot get a very friendly Legislature to add open carry to this bill, then how do we think he’s going to do trying to convince Congress to act on anything if he becomes president?”

Here in Tennessee the so-called Republicans have voted against most 2A bills that would have made our carry laws more in line with the Constitution. Grrrrr!

What exactly severe penalties???
Name them.....printing, breeze blows your shirt up?
That was taken care of long ago so Yankee tourists wouldn’t go into vapor lock.

In Florida, if you are exercising permitless concealed carry (assuming it passes) and you print or flash, you are subject to open carry penalties.

If you have a concealed permit, then you are protected.

790.053 Open carrying of weapons.—

(1) Except as otherwise provided by law and in subsection (2), it is unlawful for any person to openly carry on or about his or her person any firearm or electric weapon or device. It is not a violation of this section for a person licensed to carry a concealed firearm as provided in s. 790.06(1), and who is lawfully carrying a firearm in a concealed manner, to briefly and openly display the firearm to the ordinary sight of another person, unless the firearm is intentionally displayed in an angry or threatening manner, not in necessary self-defense.

(2) A person may openly carry, for purposes of lawful self-defense:
(a) A self-defense chemical spray.
(b) A nonlethal stun gun or dart-firing stun gun or other nonlethal electric weapon or device that is designed solely for defensive purposes.
(3) Any person violating this section commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

I can understand two things
1. Why open carry has advantages - like deterrence against criminal assaults and robberies and rapes — they see you have defenses and they usually slither quietly away. Big advantage.

All these unconstitutional infringements are inducing serious serious contempt for “the law” on a mass scale. It’s not only the probably millions of people carrying without “permits” —-these patently unconstitutional and stupid measures are creating a widespread total contempt and disregard of the law generally — much or all law , not just the silly -assed “gun laws” and “regulatiobs”

As has been observed for centuries, the law (or at least this body of “law”) is an ass

Never mind what I wrote earlier. Looking at the actual bill as amended, it appears that the legislature has closed the loophole I exposed:

House Bill H453e1

790.053 Open carrying of weapons.—

(1) Except as otherwise provided by law and in subsection (2), it is unlawful for any person to openly carry on or about his or her person any firearm or electric weapon or device. It is not a violation of this section for a person who carries licensed to carry a concealed firearm as authorized provided in s. 790.01(1) s. 790.06(1), and who is lawfully carrying a firearm in a concealed manner, to briefly and openly display the firearm to the ordinary sight of another person, unless the firearm is intentionally displayed in an angry or threatening manner, not in necessary self-defense.

Open Carry for another day.

I believe there are more important issues to tackle, such as:

1. School vouchers so parents can remove kids from government schools.
2. Get rid of ESG and DEI in all aspects of Florida life.
3. Keep making election laws less susceptible to fraud.
4. Remove wokeness from schools and universities.

Very true. And that has been my experience as well.

There does seem to be a direct relationship between the per capita numbers of northerners in a particular region and the probability of having the police called on you anyway, within the bounds of the current law or not.

I’m not against open carry- as thugs and scum criminals will think twice knowing that folks are armed to the teeth and can and will fight back- the sight is a deterrent

The downside is that a thug might be dumb enough to target an open carrier and try to steal the weapon possibly-

100% correct. “Take what you can get for now, come back for the rest later” is how the left scores so many long term victories while too many conservatives pout, sit things out and then wonder why things don’t get better.

No open carry in Texas. You can’t even bring it out to show someone. Otherwise, concealed carry is fine.

Totally wrong.

Beginning September 1, 2021, HB1927 made it legal in Texas for most people 21 or over to carry a handgun in a holster without a permit both openly and/or concealed. This law modified the previous open carry law from 2016 by eliminating the requirement to have a license to carry.

Maybe 20-30 years ago that would be a safe statement. Not today. 70 yo today for the most part, are in much better physical condition.

I guarantee you my 79 yo spouse is in much, much better shape than my mother was at 62. And I bet it’s the same in your world.

The only thing a woman that age has to fear is unawareness of their surroundings. Any of my wife’s friends, my wife or any of my adult daughters, all CCW holders, are at an age, nobody is going to walk up to them and try and take anything without getting shot first. Don’t “F” around with old bitties. You might not like what you find out.

Trying to make sense of this as the constitutional carry bill did pass. This will make 26 states, maybe next we get National reciprocity?

I carry a Ruger GP-100 in .357 with a 4 inch barrel. I carry that because that is what I have. It was given to me. I do not have another pistol. It is big pistol! I carry at the 6:00 just above the waist.

I went to Temu (Chinese Amazon/walmart.com and bough several t-shirt hoodies. These are the things people wear to keep the sun off their arms at the beach. They are very light weight and in 4different colors. They don’t look suspicious or out of place in a casual setting in sunny Houston. They completely cover the weapon. But it is still easy to reach.

Does the GP-100 print? Yeah boy! It is many things, but a small concealable weapon it is not. But I have found most people are oblivious. If they don’t see it directly they don’t register that it is a gun. They see a bulge and figure cellphone, or something.

A couple of months ago I was in line at the grocery store on the way home from church. The sweater I was wearing (Not the longer hoodies) had caught on the holster and exposed the gun. I hadn’t noticed. I noticed a lady behind me trying to corral her children away from me in the checkout line. I asked if there was a problem. She was afraid of the weapon. Normally I would have offered a 1/2 hearted apology. and covered the weapon. No big deal. But the big Hispanic guy behind her laughed and said, “Don’t let the kids near me either!” He opened his sports jacket so she could see the what looked like a .45. Then a woman in the next aisle added, “Or me!” and pulled a small semi-auto with pink plastic grips out of her purse.

I thought the lady behind me was going to have a hear attack.
