DeSantis’ office hits back after class action suit from migrants, reveals 'consent form' they allegedly signed

The office of Florida Gov. Ron DeSantis on Tuesday slammed a class action lawsuit filed by illegal immigrants flown to Martha’s Vineyard last week, saying the journey was done on a voluntary basis.

The lawsuit, filed in the District of Massachusetts, alleges that DeSantis and others “designed and executed a premeditated, fraudulent, and illegal scheme centered on exploiting this vulnerability for the sole purpose of advancing their own personal, financial and political interests.” […]

(Gov. DeSantis’ spokeswoman Taryn) Fenske provided Fox News with a copy of a consent form – available in English and Spanish – that she said was given to migrants before they boarded.

The form reads: “I agree to hold the benefactor or its designed representatives harmless of all liability arising out of or in any way relating to any injuries and damages that may occur during the agreed transport to locations outside of Texas until the final destination in Massachusetts.” …

They seem to make every list of sanctuary states I run across. I live here. Even without an “official” designation, for all intents and purposes we are. We’re pushing for ID and licenses for illegals. What else is there to say?

There’s something I don’t understand, perhaps somebody here can explain. Why did DeSantis move the illegals from Texas instead of Florida? I don’t have a problem with it but there must be a reason he didn’t move some out of Florida.

People are entitled, under various treaties to which the United States is a signatory, to come here and claim asylum.

They are not “illegal.”

DeSantorum is just grandstanding and, likely, broke the law.

They do have standing to sue despite what alot of non-lawyer freepers may think. If you are on US Soil, legally or illegally, you are protected by the US Constitution. Sorry, it may not be what alot of freepers would like to see, but that is the law. Think Al Qaeada and Gitmo, thats why they are there, not here.

The existence of signed consent forms are a basis for affirmative defenses of informed consent, waiver, and release. In this case, the affirmative defenses should be a quick winner, if the Court does not find any factual issues with the forms. If they do, then the factual issues of the defenses must go to trial, which would take awhile
