The Oral Arguments on Biden's Vaccine Mandate Were a Total Disaster

On Friday, the Supreme Court heard arguments about the constitutionality of President Joe Biden's Wuhan coronavirus vaccine mandates for private companies with more than 100 employees. In September 2021, Biden tasked OSHA with implementing and enforcing the mandates. In the time since, the administration has been sued by multiple parties.

During questioning, liberal Justice Sonia Sotomayor made a number of false statements about the vaccine's ability to prevent transmission of the virus. While it may protect against death or hospitalization, the vaccine does not prevent transmission.

"They continue to work well for Delta, with regard to severe illness and death – they prevent it. But what they can't do anymore is prevent transmission," CDC Director Rochelle Walensky said in an interview with CNN over the summer.

After 2 years, a vaccine mandate is called for on an emergency basis by an agency that watches for safety matters at work?? Makes no sense at all.

I am convinced that a majority on the Court see it as their duty to, in effect, rubber stamp whatever actions the Federal Government undertakes.

I’m not sure what to hope for here.

If the court dismisses the mandate, then Fed Gov has lost it’s attempt to expand it’s powers.

But if the court allows the mandate, then Biden will be hated by many more.

I guess I’m going to side with dismissing the mandate, because a lot of conservatives stand to lose their jobs. And that’s unacceptable.

The 1905 SCOTUS ruling on vaccine mandates clearly upheld a state’s right to mandate a vaccine. But this isn’t a state.

A little background. I taught my 7th graders the U.S. Constitution for nearly thirty years. We went though it word-by-word. So I have a decent idea of what’s in it. Of course I do have the wisdom that comes with being a wise Latina, so there’s that.

That said, even if the vaccine were proven 100% safe and 100% effective, I can not find anything in the document that gives POTUS the power to require free American citizens to take the vaccine. Nor can I find anywhere the Congress or any part of the Federal Government is given that power.

SCOTUS has been lost for awhile. They base their decisions on current events not constitutional law.

This country is fucked.

I was not impressed with the attorneys arguing for the Stay.

Seemed to me they were glaringly unprepared and unable to rebut Kagan and Sotomayor even when they were spewing obvious BS.

The whole thing was a sad embarrassment on both sides.

Progressives would say it’s an existential threat for Latin Americans too, they need all the help they can get and they can’t get it in Latin America.

Why limit it to only people that work? Don’t the unemployed or welfare recipients spread it? Retired people?
