A federal appeals court panel on Friday allowed President Joe Biden’s COVID-19 vaccine mandate for larger private employers to move ahead.
The 2-1 decision by a panel of the 6th U.S. Circuit Court of Appeals reverses a decision by a federal judge in a separate court that had paused the mandate nationwide.
The rule from the U.S. Occupational Safety and Health Administration was to take effect Jan. 4. With Friday’s ruling, it’s not clear when the requirement may be put in place.
Republican-led states joined with conservative groups, business associations and some individual businesses to push back against the requirement as soon as OSHA published the rules in early November. They argued that OSHA was not authorized to make the emergency rule.
The case was consolidated before the Cincinnati-based 6th circuit, which is dominated by Republican-appointed judges. Of the two ruling in favor of the OSHA mandate, one was appointed by a Democratic president and the other by a Republican. The dissenting judge was appointed by former President Donald Trump.

Don’t expect any help from the SCOTUS. Kavanagh and Barrett have already sided with the Deep State in previous cases. Mitch’s biggest accomplishment was conning Trump into appointing two mushy Bushites.
Obviously, they haven’t killed six million like Hitler did yet.
That mandate had, for all intents and purposes, already taken effect a few months ago. Corporations have been acting and planning, hiring and firing as though this were the law.
For them 60 million would be a satisfactory start.
Who will immediately dismiss the judgment and refer it to the 9th circuit where these cases were all supposed to be consolidated.
Why did they even bother ruling?
Doesn’t matter. I’m not complying.
This is extremely bad news for everyone who objects to OSHA being used as a tool for enforcing Resident Biden’s fascist mandates.
States must refuse to comply.
Businesses must refuse to comply.
Employees must refuse to comply.
The Constitution is the governing document of the country.
Resident Biden has zero Constitutional authority to mandate the poisons called COVID vaccines.
OSHA has Constitutional zero authority to mandate the poisons called COVID vaccines.

This is gibbons rather than monkeys at the typewriter; what the heck does it means?
I have no faith that the SC will do the right thing. Look at how many other cases like this they've refused to take on. We're being betrayed by the legal system.
Let entire 6th hear it before getting SCOTUS involved.
Barnes says it will be reversed quickly by the full 6th circuit.
What about “can’t make anyone take an unauthorized vax”?
And none of the Johnson or Moderna vaxes are fully FDA approved!
