No…it’s a State University. There is no federal issue here.

But when you don’t have a case, you pound the table.


And if you have been around long enough, you learn that you can find a dozen lawyers who will take either side of any issue you can imagine.

And that is the way it should be. Every person who has a grievance should have representation and a fair day in court, if that is his only recourse....even though it results in cases that appear to be frivolous.

I have ZERO confidence Barrett will vote to overturn Roe, should a case ever reach the Supreme Court. The Left controls the Court, just like they control everything else, except talk radio and a few websites. Just a matter of time before those disappear.

I'm no expert, but it looks like her decisions on abortion, guns, and immigration were on the conservative side.

What happens in the Supreme Court, like what happens in Congress involves a lot of inside politics maneuvering. Cases aren't heard because it's not the right time or the right circumstances or because they don't think the decision will go the right way. Nuances are a big deal.

You need a total of 4 Justices for cert, and in this case, the outcome was obvious: there was no statute preventing IU from doing what they did.

Federal funding means the federal government is always involved, but yes, it’s a state university, so the case is about state regulations.

Ok, let me try this again. The Federal Government cannot mandate masks anywhere but Federal property.

When it come to health emergencies, the Feds have zero authority. The authority lies with the state health departments.

These things are settled case law.

The SC cannot rule on something out of their jurisdiction. The financial contributions to a school have no bearing.

Why is this so hard? Why do you want the Supreme Court making rulings on issues where they have no jurisdiction.?

This was not a cert appeal though. This was a request for an emergency writ, an injunction, to block the University’s vaccine mandate until a full petition for Certiorari can be filed.
Any one Justice can issue an injunction and if the judge for that region turns it down, any other justice can act on it,

These appointments are based on recommendations.

Trump nor no other president really knows what they are
getting.

Look no farther than Reagan and Sandra Day O’Connor.

That being said, it’s easier to spot a solid Lefty than a solid
person from the right. The nominee from the Left can be
totally unqualified. They can have demonstrated wild ass
Leftist orthodoxy. They could have ruled or advocated for
activism (legislation) from the bench for decades.

Our people can look pretty good on paper. Their past cases
can look great. Then they get appointed, and the prestige
of the SCOTUS overwhelms them. They seem to overthink
and come up with rulings a high school freshman could poke
holes through, with twenty minutes of tutoring.

It sucks, but here we are.
