A Democratic congressman accused Donald Trump in a federal lawsuit on Tuesday of inciting the deadly insurrection at the U.S. Capitol and of conspiring with his lawyer and extremist groups to try to prevent the Senate from certifying the results of the presidential election he lost to Joe Biden.

The lawsuit from Mississippi's Rep. Bennie Thompson, chairman of the House Homeland Security Committee, is part of an expected wave of litigation over the Jan. 6 riot and is believed to be the first filed by a member of Congress.

It seeks unspecified punitive and compensatory damages.

Good.

Unlike federal and state courts, civil courts still have to follow the rules of evidence. They would have to prove the election wasn’t stolen.

It would be entertaining to hear liberal law professors and “legal analysts” (a/k/a Nieces and nephews of media executives who failed the bar exam) explain how this Congressman has standing.

This is another of the “full court press” to stifle any mention of election fraud and the stolen election. Doubt me? Try posting anything about the election having been stolen on your favorite social media and see what happens. They are attacking anything and anyone who mentions election fraud. They have two years to shut you up and then they can do it all over again, and this time it’s the House and Senate.

Defamation

The law suit accuses him of being in with the proud boys, 3% ers and other groups stormed the Capital. Since some were Anfifa and BLM they should have obviously been included too.

Unless they can prove he associates with theses groups, and was part of the planning, it’s Defamation.

That would be an entire POTUS term and the potential for profit on the scale of increase in net worth like Obama 300k to 75 mil. Like 150 times his net worth of 5 billion when he started office. So, like the 600 billion in damages.

He should file in Florida....

The impeachment trial was not a court of law, so double jeopardy doesn’t apply. HOWEVER, in a court of law due process and rules of evidence DO apply. Not sure if they really want to go through the discovery process and witnesses being under oath.

Well let’s see: civil complaints are subject in most jurisdiction to the litigation privilege. You cant be sued for defamation for what you put in the pleading, even if it’s false.

Ummm. I think there’s a causation issue with the notion that one lost ones office on account of the filing of a lawsuit after one leaves office.

I perceive a bit of a problem with the damages being a bit speculative.

I would agree with you that, if such a case were to succeed anywhere, it would be with a jury consisting of Floridians

Well, now we might just be able to see what Pehosi was hiding. Now Trump can subpoena the House Speakers files to get to the bottom of this. If the judge disallows, then appeal the decision and work it up the courts. Demoncraps are truly dummies most of the time.

I have litigated cases under this statute and this lawsuit is totally stupid. There is no application of this law to Trump.
