Were I in the Senate I’d argue that since only a sitting President can be impeached then this acknowledges that President Trump is and remains the POTUS.
Those five Repub Senators need to be primaried.

About half of the senate voted that the trial is unconstitutional and the other half voted that it is not unconstitutional! Half of them are wrong. Half of them are breaking their oath to uphold and defend the Constitution! Wouldn't they want to follow the law and honor their oath of office? Why would they not ask SCOTUS to decide whether the trial is constitutional?
