PA lawsuit in Commonwealth Court to enjoin certification of election

A group of Republicans, including Rep. Mike Kelly (R-Pa.) are launching a lawsuit — in the hopes of blocking the certification of Pennsylvania's election results — that claims a state law passed in 2019 allowing for universal mail-in voting is unconstitutional. If that were the case, mail-in ballots would be invalidated, likely swinging the state back to President Trump.

The legislators have standing the PA. SC better not reverse this NO WAY!! They know the law and will be SLAPPED DOWN by the SCOTUS!!

The court and SOS passed this the PA. constitution states that election laws are passed by legislators PERIOD!!! The governor could not get it through the legislators SO he took the back door and is totally unconstitutional!!!!

Will be thrown out due to lack of standing, which is what they always get away with even when the plaintiff has standing as in this case.

It is simply absurd for a court to rule that a candidate for POTUS has no right to challenge illegalities in the election. Even Belarus is laughing at us over that. SCOTUS needs to clean this up. Had Johnny Roberts voted to grant certiorari earlier, the lower federal courts might have acted more professionally hearing these cases.

Sure, PA legislators could join Trump’s lawsuits to force the issue in federal court. This case was filed in PA’s Commonwealth Court which has different rules than federal courts.

They have until Dec 8th to file. They have until Dec 14th. That is when the vote is.

State laws govern elections.

What works in PA is probably not applicable to CO.

I wouldn’t get your hopes up—they had only been working on mail in balloting since the spring.

The US Constitution states that elections are decided by state legislatures. Pa Constitution is only validating this fact. The law comes from the top, Federal level, not at the State level. This allows the SCOTUS to adjudicate this issue and make a decision on whether or not the PA Court and the SoS breached the separation of powers for the State of PA based on what transpired before election day.

I'm not PA, but out of country and my locality has similar requirements for absentee voting. The bar was high, with an absentee ballot application requiring several pieces of data, a witness, an attestation, a registrar approval, and finally I received a ballot which had to mailed (not emailed) to my locality from abroad.

But I probably received a half dozen "mail in ballots" at the locality home address where I don't live anymore.

As American Citizens and voters, we were told often and repeatedly and long in advance how fraudulent these mail in ballots would be. And they have been, demonstrably.

Understood. I'd like to see it established that mail voting is unacceptable and the Constitution says that the state legislatures need to set election day

, with few exceptions, not election month.

Which court was it that said that a pandemic doesn’t mean the Constitution can be violated?

I would think barrett Kavanaugh Thomas & Alito.
Is Gorsuch a textualist. I know he’s taken liberties with text before.

Isn’t the whole point because ott pertains to other states?
If one SOS can’t override their state’s constitution, then none can.

I think that’s the wrong part of the constitution. Mail in voting is technically different from absentee voting will be the claim.
