Trump Suggests Nominee Could Tip Supreme Court to Overturn Roe V. Wade
epoch times ^ | September 27, 2020 | JACK PHILLIPS

President Donald Trump said he believes his Supreme Court nominee Amy Coney Barrett could tip the high court toward a decision to overturn Roe v. Wade by possibly allowing individual states to decide whether they should ban abortion.

“She is certainly conservative in her views, in her rulings, and we’ll have to see how that all works out but I think it will work out,” Trump told Fox News on Sunday.

When asked about whether the landmark abortion ruling could be overturned, Trump said, “It’s certainly possible. And maybe they do it in a different way. Maybe they’d give it back to the states.”

“You just don’t know what’s going to happen,” he noted, adding that Barrett as well as Justices Neil Gorsuch and Brett Kavanaugh would “rule on a life issue.”

In the interview, Trump noted that justices that he appointed wouldn’t necessarily hand over rulings after some decisions by the court that he didn’t favor, including one in July about whether Trump could ignore a subpoena calling him to release his tax returns. Gorsuch also joined the liberal wing of the Supreme Court that declared workplace discrimination against LGBT employees as illegal.

“I’ve been surprised by some of the rulings that we’ve already had over the last year. You know, you think you know somebody and then you get rulings that are a little bit different than you think could happen,” Trump said, adding that he is “mostly” looking for a justice who “can interpret the Constitution as written.”

“And maybe they do it in a different way. Maybe they’d give it back to the states.”

Where it belongs. That way people can vote with their feet if they don’t like the laws of the state they’re in.

If Roe went away it would return to the states. There’s no appetite to overturn Roe. Even if you have Barrett on board, there’s probably only two other votes. Thomas and possibly Alito. Roberts isn’t going to go that way. There’s not going to be five. There might be five in allowing reasonable limits like where abortions are performed or requiring admitting privileges or banning abortion survival infanticides but Roe isn’t going away even with Barrett on this court.

Trump’s statement will still send them into a tizzy, which was it’s main purpose.

“Look! Squirrel!”

I’m sorry Trump listened to his advisors and chose the seemingly politically advantage of picking a woman for the Supreme Court Justice. Trump’s already got the 2020 election in the bag - should be a landslide - didn’t have to do this to get that.

I have yet to see and hear any woman clearly renounce the bloody and false doctrine of the Women’s Movement and I doubt this lady will either. IMO there’s a good chance she do the fast shuffle left upon entering the Supreme Court Entryway and will not help bring down the utterly unconstitutional and horrific Roe v. Wade.

You may have seen this in other threads. I think I’m one of the few voices who dare say these things.

Nevertheless, let the flaming begin...again.

It has to be such a decisive tsunami that it overwhelms the Democrat margin-of-cheating, and they have pulled out all the stops this time.

Trump needs to SHUT UP. They can turn on her for what he says. He should say what he said in that speech of his, and nothing else. This is too important for him to talk about. Let her speeck for her. He can only hurt her if he talks about it.

Read what he actually said. He said nothing wrong or untrue.

Send it back to the states and let the states decide.

In the end....NY and Ca will have abortion. Perhaps 50 years hence, people will get a conscience cuz that's what's missing.

I am not saying if its true or not. I think what he said is true. I think he should not say it. She will be branded with anything he says. She is his pick. So if he says things like this, squishy senators will have a hard time with the vote. He needs to shut up. He needs to say, that its about time that a mom with kids in school, becomes a Supreme Court Judge. He should leave it, that she will follow the constitution and the law. He should not go further. He should remember that the media will take whatever is coming out of his mouth as if it came out of hers. So he should shut up.

There are two arguments that are made to dismantle Roe.

The 1st argument is the one that gets most attention and loses. That’s the argument centering around the question, “When does life begin?”. The faithful will answer that life begins at conception. But this argument never stands up in legal proceedings because it has a religious underpinning.

If it could be ruled that life begins at conception, Roe would fall as abortion would be the taking of life, of a human being. But the legalistic view is that this is based on a religious view.

We could argue this first argument until we are blue in the face. It goes nowhere legally. It attracts side protests such as, “My Body, My Choice!”.

The 2nd argument is barely a whisper and is a fearsome weapon against both the abortion groups and the Supreme Court itself.

The 2nd argument is that the Constitution does not allow for a right to an abortion.

In Roe, the Supreme Court stretched a right to privacy to a right to abortion. But this prior decision was in error not because of error in applying rights of privacy to abortion but because the issue was not a federal issue.

The right to an abortion is simply not an ENUMERATED RIGHT.

Therefore, it falls to the individual states to take it up and as a consequence, Roe falls.

This 2nd argument is superior because there are no moral pleas and arguments that can get bogged down, no drama, no emotion. It simply ISN’T THERE.

She’s also a woman and I’ve seen how they can change their mind pretty quickly especially given the right set of circumstances. One of those circumstances is the largesse of the Supreme Court itself which has withered many a “stanch conservative.”

I’ve seen “staunch conservative women” turn into flaming leftists. The presumption is she doesn’t belong there which doesn’t help.

I’d like to be wrong. I’d like to think that she is the exception. But I’m not counting on it.

I don’t think Roe vs Wade will go away anytime soon. I think what we will see is that the Supreme Court will allow states to restrict abortion somewhat but the doctrine will never go away.

Patriots are reminded that, in stark contrast to the rights that the states famously amended to Constitution with the Bill of Rights and later rights amendments, the states have never amended the Constitution to expressly protect the evil, politically correct right to murder unborn children.

More specifically, since federal lawmakers don’t have an express constitutional right to have an abortion to throw at the states through the 14th Amendment to win votes to help them stay in power, corrupt Democrats stay in power by fighting tooth-and-nail to maintain a Constitution-ignoring, tyrant activist justice majority who wrongly legislate vote-winning, politically correct civil rights from the bench.

In other words, corrupt, post-17th Amendment ratification Democrats have been wrongly using scandalous Roe v. Wade to exploit low-information voters, winning their votes by supporting Roe v. Wade imo.

Send “Orange Man Bad” federal and state government desperate Democrats home in November!

Supporting PDJT with a new patriot Congress and state government leaders that will promise to fully support his already excellent work for MAGA and stopping SARS-CoV-2 will effectively give fast-working Trump a “third term” in office imo.

I don’t see any problem with voting Republican ticket for 2020 elections.

Insights welcome.
