The complaint says that the punk was indeed shot in th back, but also says most of the struggle happened while the the punk was trying to get the gun from Kyle. It implies that Kyle got free , circled around and shot him in the back. There is no mention of the wound caliber so one of the many armed punks could have shot Rosenbaum., death shot was from the rear
