Trump Isn’t Impeached Until the House Tells the Senate
Andrew Clark twitter ^

Posted on 12/19/2019 4:16:08 PM PST by Bigtigermike

A House Democrat impeachment expert just wrote an opinion article stating that impeachment is a process not a vote and that Trump could legitimately say he wasn’t impeached at all because impeachment is seen through the lenses of the constitution as a whole -impeached in the House and then sent to the Senate for the trial. You can’t have one without the other

That crazy resolution was passed by majority vote of the house of representatives. That constitutes impeachment, the passing of the articles.

Impeachment is simply a charge that the House levels. It still requires the Senate for a conviction of that charge. I still think the whole thing is Democrat revenge for the impeachment of Clinton.

Let’s go back to Bill Clinton. He was impeached in the house but not the senate.

Did the vote get sent over to the Senate?

Harvard Law Professor (and pretend Harvard history professor) Feldman is the so called impeachment expert quoted here. And he is a snake with severe TDS. There is no way he would marshall the facts even if they existed to say something benefiting Trump.

I urge you to read the underlying bloomberg article. Feldman keeps making the same assertion over and over and saying there’s history behind it but he never gets around to actually providing the evidence.

So why would he do this?

As Sundance at Conservative Treehouse points out this impeachment is a means not an end. The House is arguing in court to obtain all of Mueller’s grand jury testimony which is sure to have a lot of juicy unsubstantiated but fit for the so called news media gossipy tidbits. The courts have said maybe not because you never opened a formal impeachment inquiry which the didn’t because it would have given the House minority rights to call witnesses etc.

Now they can say “our House managers need this info for the trial”. This way they get what they want, while skipping the part where Nunes and co ever had a chance to call witnesses.

All they need to succeed is:

1. McConnell to say no more witnesses. Check
2. McConnell to NOT DISMISS OR ACQUIT before the court unseals the testimony in late January.

Feldman’s article is designed to further #2.

Dunno. Lots of opinions out there. Sounds like wishful thinking.

The House not only told the Senate but told the entire world that Trump is impeached. The Articles of Impeachment are available for all to read.

And Nancy Pelosi seems not to care. This is as tiresome as watching someone swing their arms in a circular motion trying to generate electricity.

No matter what it looks like, ain’t gonna work.

The job isn’t done until the paperwork is finished.

And so far, this is just a piece of paper floating around.

This whole thing is ‘beyond my paygrade’!!!

The article states it is a process.

“According to the Constitution, impeachment is a process, not a vote.”

I have no idea, but do think we are in uncharted waters! jmho! Free and that is what it is worth. 0

I got your constitutional scholar right here.

What does an impeachment vote mean for a sitting president?

A president can continue governing even after he or she has been impeached by the House of Representatives. After Bill Clinton was impeached on Dec. 19, 1998,he finished out his second term, which ended in January 2001, during which time he was acquitted in a Senate impeachment trial. While Clinton continued governing, and the impeachment had no legal or official impact, his legacy is marred by the proceeding.

I did this all morning on the other thread no longer interested in doing remedial training of impeachment deniers. Good luck saying Trump hasn’t been impeached to normal people.

If you are charged with a crime by someone, and they go to the police to complain, but yet they do not file charges, then are you still labeled a criminal? Answer - No!

There are a lot of knuckleheads on this forum that can’t see what you are saying. Impeachment is a process. It is not complete until it is filed in the Senate. Once the House submits the articles to the Senate, then the Senate takes up the case.

At this point the Senate has no jurisdiction. Why? Because at this point Trump has not been impeached. Once there is a formal impeachment the Senate has sole Jurisdiction to try it.

You can’t claim that Trump is impeached if the Senate has no jurisdiction to try it. The House has to file it with the Senate.

OAN Newsroom
UPDATED 6:10 PM PT — Wednesday, December 18, 2019

A long-day of debate finally came to an end with lawmakers in the House voting to impeach President Trump. On Wednesday evening, lawmakers approved articles of impeachment against the president for both the abuse of power and the obstruction of Congress. The first article passed in a 230-to-197 vote while the second article passed in a 229-to-198 vote.

Another vote, which will take place later in the week, will inevitably lead to a trial in the GOP controlled Senate. There, Democrats will need a two-thirds vote in order to remove President Trump from office.

Wednesday’s vote makes him the third president in U.S. history to be impeached, following Presidents Andrew Johnson and Bill Clinton.

The vote wrapped up weeks of testimony related to President Trump’s dealings with Ukraine. The House Judiciary Committee approved rules for impeachment last week in a 23-to-17 vote.
