Alabama Sues Over How Census Counts US Population

The state of Alabama is suing the federal government over how it counts people in the census, claiming it will lose a seat in Congress because it has a low illegal-alien population.

The lawsuit, filed May 21, 2018, in U.S. District Court for the Northern District of Alabama, is garnering attention now after two federal judges permanently enjoined the Trump administration from adding a citizenship question to the 2020 census earlier this month.

The dual rulings came after the Supreme Court ruled June 27 in Department of Commerce v. New York that the citizenship question couldn’t be included in the once-a-decade census. Backed by the four liberal justices, Chief Justice John Roberts rejected Commerce Secretary Wilbur Ross’s claim that the citizenship question was needed to gather data to help enforce the Voting Rights Act, writing that the rationale “seems to have been contrived.”

“Seems totally ridiculous that our government, and indeed Country, cannot ask a basic question of Citizenship in a very expensive, detailed and important Census, in this case for 2020,” President Donald Trump wrote on Twitter.

This is an important suit. Unfortunately, our legal system is so broken that by the time anything is decided the point will be moot.

You misunderstand the purpose of the 3/5 compromise. It was demanded on the part of states with low slave populations so as to decrease the political power of those with higher slave populations by reducing their population counts. As such, Alabama would naturally have been opposed to it.

Exactly. It's ignoramuses like that who literally have their thinking hat on backwards.

The southern states WANTED to count their original black slaves as a full person. Why? Because it would have given them MORE political power in the federal government (i.e. more seats in the House). It was the northern states that wanted the 3/5th's number.

Imagine if the south of the late 1700's & early to mid 1800's had more political power. The scourge of slavery most likely would have gone on longer and caused an even bloodier civil war that may have turned out differently.

Representatives to Congress represent the voters of the district from which they are elected."

That's right.

Ambassador's and their staff from foreign countries live in our country. Although, small in size by comparison, should they be counted in our census? Of course not.

There are lots of people who are temporarily living in our country, for example, on business, on vacation or visiting relatives over the course of a month or two. Should they be counted in our census as well if they happen to be living in the house/condo/apartment at the time the census taker passes by? Of course not.

Only citizens should be counted.

The amendment says “their respective numbers” the invaders are not theirs and must not be counted.

Would you count the members of the Mexican army if Mexico officially declared war on us and occupied Arizona?
NO, you would not.

The civilian invaders are not different, they must not be counted and their children DO NOT receive citizenship just because they are born on US soil.

Read as a whole, the illegal immigrants can be discounted initially as transients, or counted and then discounted as being neither citizens nor legal residents. Either way they must be identified, and in neither way are their numbers to be used for apportioning representation.
