Mother of toddler who died after ICE detainment sues US for $60 million

The mother of the 1-year-old child who died after being released from a family detention center is filing a claim against the U.S. government. Attorneys for Yazmin Juarez filed a legal claim on Tuesday seeking $60 million from the government for the death of her daughter, Mariee, according to The Associated Press.

The news service noted that the claim is against multiple agencies.

Lawyers for Juarez are arguing that Mariee developed a respiratory illness while she was being held at the South Texas Family Residential Center in Dilley, Texas after being detained.

They are accusing Immigration and Customs Enforcement (ICE) of releasing Mariee despite treating her condition.

Mariee died six weeks later in Philadelphia after being hospitalized for respiratory failure.

The law firm Arnold & Porter told AP that it will file a lawsuit against the government if it doesn't settle its claim. R. Stanton Jones, a lawyer at the firm, told AP that the government has six months to respond to its claim.

“Having made the decision to jail small children, the U.S. government is responsible to provide living conditions that are safe, sanitary and appropriate,” Jones said to the news service.

ICE and other agencies listed in the claim declined to comment to the AP about pending litigation.

“ICE takes very seriously the health, safety and welfare of those in our care,” spokeswoman Jennifer Elzea said in a statement.

The Hill has reached out to ICE for further comment.

The AP notes that the detention facility in Texas has received repeated complaints about alleged substandard care. Advocates have argued that detaining families can lead to damaged mental health.

ICE has pushed back against the criticism, saying that detainees have access to medical professionals.

Juarez and her daughter arrived in the U.S. in March seeking asylum, according to CBS News. Juarez has previously alleged that her child received substandard medical care at the detention center they were held at.

If not it had nothing to do with being in the holding center.

Imagine if we had shoot on sight orders for shysters who took these ridiculous cases.

Put signs up on border in spanish. “do not attempt to cross the border- all legal risk is on you if you are injured and/or die trying to do so”

Why is not done the same thing that was required from me in a refugee camp (1986) in Austria after I applied for USA asylum:
1., Swore in writing that I had no any pre-existing medical condition,
2., Take a chest X-Ray to check on my lungs,
3., Have a blood test and general medical check-up.
And, this was just the medical part of the asylum process.
I stop here, because I am extremely furious and fed up with these illegal aliens and their demands. Never let them step on USA land; instead keep them outside of our territory and let them prove there what we need to know about them.

That’s pretty damn crazy and sick but, so is the fact that our congress will not fix the laws that lure them here or, that we the people will not go to DC and decorate some light posts or, even go in just peaceful or, perhaps even armed protests to demand that they do their job.

Having made the decision to illegally bring her small child into the country and thereby place her in a situation that could cause her detainment, the mother is responsible for any effects of said detainment. There. Fixed it.

Well 20 yr. old Juarez and her daughter were caught when they ‘illegally’ crossed the Rio Grande from Mexico in March. So as I see it she chose to break the law and that has unexpected consequences. She also had access to Medical at the center.

Looks like Activist Attoney’s in Washington, ( law firm Arnold & Porter) said it will file a lawsuit IF the government doesn’t ‘settle’ its claim. As all alaw firm Arnold & Porter said it will file a lawsuit if the government doesn’t ‘settle’ its claim.

This is obvious a political suite....with the added bonus of $$$$$$ going into the Activists pockets.

The mother says that she and her child were housed with sick children in ICS custody, and were released after Mariee became ill.

Her mother took her to a pediatrician after they flew to be with family in Philadelphia, who sent them to the ER as the child was so sick. She was admitted and spent the last six weeks of her life in the hospital.

The mother is responsible for the reckless endangerment of the child by her actions which sadly resulted in the baby’s death. She committed a misdemeanor resulting in a death. I would imagine this would negligent homicide.
