Asylum seekers sue Trump, claim border stance violates their Constitutional rights.

A dozen migrants traveling by foot from Honduras to the U.S. to seek asylum filed a class-action lawsuit Thursday against President Trump, the Department of Homeland Security and others, claiming a violation of their due process under the Fifth Amendment.

The Fifth Amendment states that, "no person… shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law."

A recent PBS report cited former Supreme Court Justice Antonin Scalia, who ruled in 1993 case that "it is well established that the Fifth Amendment entitles aliens to due process of law in a deportation proceeding."

My word!!! If this lawsuit is allowed to proceed, and some crazy judge will allow it to, what is the limit? What is to stop some foreign government to sue to stop U.S. military action against it, or tariffs, or sanctions? All they would have to do is have their citizens sue for a violation of their constitutional rights.

The irony here is that to left, the migrants have more rights than us deplorables or even a guy like, say, Brett Kavanaugh.

This is hysterical. They’re not Americans. They have no constitutional rights.

The irony is, why would they even have to sue at all if they intend on immigrating legally?

The 5th Amendment doesn't apply until they actually get into the country. They have a ways to go.

Citizens of other countries do not have a Constitutional right to invade our country.

They (and their anti American lawyers) want to change our laws to accomodate their staying in the US ... free.. and taken care of.
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Plenty of Bush League Republicans also want to help them.
Rubio, Graham, Alexander, Heller, Murkowsky, Hoeven, Hatch, Flake, Corker, McCain all voted to change our laws to help the 30 million already here to stay.
What constitution is that, the UN’s?
Build a border wall; End the anchor-baby interpretation of the 14th Amendment; Enforce E-Verify without exception and with severe penalties; End chain migration; Deportation upon contact with any law enforcement agency - federal, state, or local; No “path to citizenship,” ever, for anyone who has entered the US illegally.
And don’t let this “caravan” full of uppity, hostile, would-be freeloaders step one foot on our soil.
The whole suit thing is a farce, but Democrats expect it to be taken seriously to get their illegal alien invaders into the population where they will vote Democrat so as to enable Democrats to take away our money, our guns, our vehicles, our suburbs, our right to free speech, our right to redress grievances, our right to avoid self incrimination, etc.
And if it is treated with even a fraction of the utter contempt it deserves they'll scream racist or some other such bovine fecal matter
Can I sue over not being allowed to live in Nancy Pelosi’s giant mansion? It’s my constitutional right.
Yes, Honduras is a Republic and have until very recently been very pro US. They ousted then President Mel Zelaya a number of years ago because he tried to get the constitution changes to allow multiple terms of office for president. It was explicitly forbidden by the Constitution and they (legislature and Supreme Court) removed the president for violating the Constitution.
They picked him up in hi PJ’s and flew him to the border of Costa Rico and dropped him off. Smile.
Honduras is a very poor country, last 10 years the Drug cartels have gained ground, most of Hondurans are not involved in this “caravan” and most are good people.
Once here they do have Constitutional rights....although they’ve no “right” to be here illegally. To think that an invading army has a “right to invade” is just idiocy.
How is this any different than a bank robber saying placing him under arrest violates his constitutional rights?
Yeh I think Scalia was talking about someone already here who overstayed their visa or married to get a green card.
Tell the caravan to turn left at Tijuana-—they will be allowed to enter & be processed at Hilo.
The only right they have if they are here illegally is to be summarily ejected. To say they suddenly have Constitutional rights simply by virtue of standing on US soil is to concede the false argument to the “birthright citizenship” types among other lawless US-haters.
