Knowingly exposing others to HIV will no longer be a felony in California

Gov. Jerry Brown signed a bill Friday that lowers from a felony to a misdemeanor the crime of knowingly exposing a sexual partner to HIV without disclosing the infection.

The measure also applies to those who give blood without telling the blood bank that they are HIV-positive.

Supporters of the bill said women engaging in prostitution are disproportionately targeted with criminal charges, even in cases where the infection is not transmitted.

Republican lawmakers including Sen. Joel Anderson of Alpine voted against the bill, arguing it puts the public at risk.

“I’m of the mind that if you purposefully inflict another with a disease that alters their lifestyle the rest of their life, puts them on a regimen of medications to maintain any kind of normalcy, it should be a felony,”

I was frankly shocked that prior to this bill’s passage, California had such strict laws regarding AIDS. A throwback to a saner age?

I can’t imagine why someone, anyone, would threaten the blood supply. There has got to be some injunctive relief somewhere, and soon.

Using the same logic if I point a gun at someone and pull the trigger and they die my defense should be “I did not know it might kill them.”

HIV positives that have sex and do not tell the partner know “their gun” was loaded and know it might kill their sex partner.

Jerry Brown is insane.

The entire U.S. blood supply will be tainted. The Feds better step in.

Remind me to never go to LA and hire a crack whore.

Why go through all the risk of getting mugged or stepping on a needle?

Just go have an accident, get taken to the hospital, and get some blood. The end result will probably be the same (for you). If you survive the hospital, you'll have a fair chance of a slow, lingering death from AIDS or Hepatitis.

But at least the "gay" community won't be insulted.

My question...Can donated blood given by a gay with new hiv ,even he doesn’t know yet,be caught when it’s tested??? Or can they only catch the hiv after its full blown..There is a 2-4 week period when it starts up in your body and you don’t know it yet.....

Only exposing others through donating HIV-laced blood should be a felony. Let them continue making HIV the “gay disease.”
