GOP Rep. Introduces Legislation to Nullify State-Level Gun Controls

Rep. Chris Collins (R-NY) introduced legislation Monday aimed at nullifying state-level gun controls that exceed gun controls put in place by the federal government.

New York’s SAFE Act (2013) is a prime example of the kind of gun control Collins hopes to erase. WKBW reports Collins’ bill is titled the Second Amendment Guarantee Act (SAGA), and its language explicitly “[limits] the authority of states to regulate conduct, or impose penalties or taxes in relation to rifles or shotguns.” It is designed to catch laws that go beyond federal statutes and render them void.

According to the Buffalo News, Collins described SAGA, saying, “This legislation would protect the Second Amendment rights of New Yorkers that were unjustly taken away by Andrew Cuomo. I am a staunch supporter of the Second Amendment and have fought against all efforts to condemn these rights. I stand with the law-abiding citizens of this state that have been outraged by the SAFE Act and voice my commitment to roll back these regulations.”

Federal preemption being used for a Conservative cause, what a concept.

This should get through the House, but the Senate would be more difficult. Would the Senate RINOs support this bill?

There are many Democrat Senators up for election that are in states that voted for Trump and are very gun friendly and this will be a wedge issue. If it helps turn a few states over to the GOP it is a good thing. If it passes it is a miracle for people in states like California.

A conservative cause is to Senate RINOs like sunlight to a vampire ... no way in hell will they support it.

And if a future Congress passed laws restricting magazine size or type of firearm that states could allow would people be happy with that as well?

It's a 10th Amendment issue. Leave it at that.

Tell that to the people living in New York, California, Connecticut, Massachusetts, New Jersey, Illinois, and other states already living in a restricted hell and outlaws in their own country from unconstitutional laws already that nobody does anything about.

We already have more damage being done and if you think this will not migrate to other states you would be mistaken. This needs to be enacted at the Federal level and would also make unconstitutional laws more quickly advance to the SCOTUS. It is far to long to let states like California and New York get away with this garbage and have conservatives move away only to allow these states to be totally overrun with democratic majorities.

I’m against the feds meddling in areas that belong to the states, but IMO the 2d Amendment is a federal, Constitutional issue.

US citizens should NOT be barred from keeping and bearing arms with a patchwork of state restrictions. If I buy a gun in state A, I ought to be able to travel with it anywhere in the US without a problem.

Restricting magazine size would be, IMO, unconstitutional.

This is a bit different IMHO. Aren’t all the States guaranteed a republican form of government? Setting a minimum standard of liberty in such a clear cut area would seem much different than Congress doing the opposite. And before anyone makes the argument about federal imposition of Sodomite whatever posing as marriage, that is at minimum a 10th amendment issue, but also an issue of religious freedom, freedom of association etc. People who self-identify as Sodomites were always free to marry someone of the opposite biological sex.

No. The Supreme Court in the Heller decision stated that states cannot outlaw firearms. Hadn't you heard about that? Happened in 2008.

But back to my original question. If you are fine with the federal government telling states what they have to do concerning firearms then I assume you're also fine with the federal government telling the states what they can't do?

Yep, you’re right. There’s endless Federal meddling and ever-growing Federal power. If a state law on anything is broken, it is up to the people of that State to fix it.
