BREAKING NEWS!

Today North Dakota became the tenth state to successfully adopt our Article V legislation! This is a historic victory for the grassroots warriors of COS North Dakota, our legislative champions, and the American people.

North Dakota joins nine other states calling for an Article V Convention of States for the purpose of proposing constitutional reforms that limit the power and jurisdiction of the federal government, impose fiscal restraints, and set term limits for federal officials, including Congress and the judiciary!

Americans see a flailing federal government that is out of ideas. We are ready to break the shackles of big government and return decision-making where it was belongs.

Repeal the 17th amendment and balance will be restored to government.

Agreed.

The only worthwhile amendments are of a structural nature, those that cannot be gaffed off or overturned by a Leftist president backed up by a progressive scotus.

If the 17th Amendment is repealed, as it should, the reinvigorated senate of the Framers’ design will stomp on the administrative state. Never again will anti-10th Amendment lawyers have a place on the federal bench.

Certainly agree on the 17th. Once repealed, no way to weasel out of that one.

Great news! 10 states down, 24 to go!

We are fighting for the soul of our Sacred Republic. The terror attack in London and the demands for a "new Constitution" are signs of a quickening in this battle.

For those who think the Article V process is too risky, I ask, "What other options do you see?"

To summarize from a previous post by GraceG:

1. Elect More Republicans - Failed due to RINO/Uni-party confluence.

2. Article V Convention of States to propose Amendments - Needed to try to take power from the federal government back to the states and reel in the federal leviathan.

3. State Nullification - Last ditch effort to try to take power back from the federal monster, though by this point it may be too late.

4. State Secession - Could either end up peaceably like the breakup of the Czechoslovakia in 1993 or a brutal:

5. Civil War II like the first one.... The longer we wait on #2, the more likely #3, then #4 and finally #5. .

So, do we do nothing and just wait for # 5?

Quick review: We need 34 states to pass an application, then Congress shall, by law, call a Convention of States as soon as it receives applications from 2/3 of the State Legislatures. That's 34 states. As of right now, there are 10 states that have applied using the Georgia language: AL, AK, AZ, FL, GA, IN, LA, ND, OK, TN. 10 down, 24 to go.

So far, 36 state legislative chambers or bodies have filed or passed resolutions. Amendments are proposed and voted on at the convention. Each Amendment must be ratified by 3/4 of the states in order to become part of the US Constitution. That's 38 states.

There are multiple arguments against a COS. Do not be dissuaded. In reality, there are so many checks and balances against a runaway convention that the risk is near zero. As nathanbedford said, “It requires only 13 statehouse legislatures from 13 different states out of 99 legislatures in 50 states to block an amendment. The problem is not a runaway convention, the problem is getting any amendment through."

"There are far more political and legal constraints on a runaway convention than on a runaway Congress." - Robert Natelson

Most FReepers are aware of these links, but I post anyway for review and for people new to Article V. It is our responsibility to make Article V the most understood aspect of the US Constitution.

AFAIK, no one ever disputed your timeline of options 1-5. Duh, they just follow the course of nature. If we are to avoid the curse of history, we must return to first principles!

That's for sure. The recent health care non-vote debacle proves the Uniparty is front and center.

Bull Flop. We have a great constitution that no one follows.

Jefferson said we should have a revolution every twenty years. Lets have that revolution...bloodless or otherwise to re establish our near perfect document.

Nothing wrong with the US Constitution other than the fact that it is ignored by both parties.
The battle needs to be to stick the politician’s noses into the truth of originalist observance. Not by lawyers. We’ll hang those later

Bull Flop. We have a great constitution that no one follows.

The founders put Article V in the Constitution to deal with just the situation we have today. Short of a hot revolution, this is the last sane step that can be pursued by patriotic Americans before nullification, secession or civil war.

The Article V Convention of states and the suggested Amendments by Mark Levin seem to be the only bloodless way to right the ship of state, specifically the following eleven amendments:

Impose Congressional term limits

Repeal the Seventeenth Amendment, returning the election of Senators to state legislatures

Impose term limits for Supreme Court Justices and restrict judicial review

Require a balanced budget and limit federal spending and taxation

Define a deadline to file taxes (one day before the next federal election)

Subject federal departments and bureaucratic regulations to periodic reauthorization and review

Create a more specific definition of the Commerce Clause Limit eminent domain powers

Allow states to more easily amend the Constitution by bypassing Congress

Create a process where two-thirds of the states can nullify federal laws

Require photo ID to vote and limit early voting

In reality, the Beltway is not going to pass the above needed amendments nor honor the constitution until new people and a new mindset is there. Term limits would change the D.C. climate in a hurry. The only bloodless avenue for this is an Article V Convention of States.

I was never for it, and I am still not.

Just examine the facts. If all “facts” point to the Constitution as the problem, then why is the “fix”, Article V so difficult to obtain?

Try the Article VI solution rather than the Article V.

Exactly.

If they’re not going to follow the Constitution now as the law of the land then what’s to stop them from unfollowing the amended one when it doesn’t suit them?
