Twin Peaks Biker Couple Says Charges Dropped, But Not Dismissed

WACO -- The attorney for a biker couple arrested in connection to the Twin Peaks shooting says his clients cases have been dismissed, but the McLennan County District Attorney says that’s “not accurate.”

While they’ve been released from their bonds and have no charges pending, their cases have not technically been dismissed, but William and Morgan English believe they’re a step closer.

Houston-based defense attorney Paul Looney represents the biker couple from Brenham who were the first ones at Twin Peaks released from the McLennan County Jail. The Englishes are members of “The Distorted” motorcycle club, an alleged support group of the Bandidos, one of the two main motorcycle gangs involved in May’s biker brawl at the Waco Twin Peaks restaurant which left nine dead and at least 20 injured.

Now, ten months later, Looney said in a press release Friday that his clients were cleared since they weren’t indicted by the Twin Peaks grand jury before midnight.

“Judge Strother met this morning with DA Abel Reyna, Assistant DA Michael Jarrett and I. The Judge agreed he did not sign an order to continue the prosecution of the unindicted cases and because that grand jury’s term has expired without an order extending the prosecution was signed, the prosecutions against the 39 unindicted bikers are terminated by operation of law and their cases are dismissed,” said Looney in the press release.

McLennan County Criminal District Attorney Abel Reyna said Looney's statements were not true.

“Mr. Looney’s version of what transpired today is sadly inaccurate,” said Reyna. “We have not filed any dismissals in any of the remaining Twin Peaks cases. Furthermore, any McLennan County Grand Jury can hear evidence on this matter and decide to issue additional indictments. This is an ongoing, continuing investigation.”

After reading Looney’s press release, Reyna responded with a second statement.

“Mr. Looney's second statement regarding what happened today is a little more accurate. However, the meeting took place in front of Judge Matt Johnson and we all agreed that regardless of the operation of law, the State was not prohibited from presenting the remaining cases to a different grand jury. As I stated previously, this is an ongoing and continuing investigation.”

The Englishes said they were not too worried about future indictments because they arrived at the restaurant only minutes before the gunfight and weren’t part of the violence.

“Of course there's always gonna be that worry in the back of your head, but now it’s like the only way they can ever really indict us is if they find physical evidence on us and there's nothing to be shown, so, so that part doesn't really worry me,” said Morgan English.

The Englishes have contended from the beginning, they were just in the wrong place at the wrong time.

“Why worry about something that’s not there?” said William English.

The Englishes said they have spent most of the last four months worrying about their baby; Morgan learned she was pregnant in January and has had complications with the pregnancy.

The couple was arrested on May 17th on $1,000,000 bonds for engaging in organized crime with the underlying offense of aggravated assault and murder. They were the first two bikers released from Jail two weeks later. William said he had lost jobs as a result of his jail time and the accusations. Morgan said fighting the Twin Peaks charges has taken everything they have financially.

“It’s been hell,” said Morgan English.

The couple said they were unsure about pursuing any legal action against McLennan County.

“We’re weighing our options,” said William English.

KCEN Legal Analyst Liz Mitchell said any of the Twin Peaks bikers who haven’t had cases presented to a grand jury yet, like the Englishes, can still be indicted at anytime because the underlying offense of murder has no statute of limitations in the State of Texas.

The political webs of influence are thick and packed with intrigue.

On one level this is yet another scapegoating exercise. The Hells Angels etc. according to the flesh aren’t the worst menace America has seen. Many actually behave themselves in a civilized manner. The worst ones are the ones that are literal demons. And they can drive both the “private” world and the “government” world to madness.

“The DA is one evil bastard.

He’s the Texas version of Mike Nifong, and you know how he ended up. Abel Reyna needs to be prosecuted and disbarred, and Waco needs to be up against millions of dollars worth of lawsuits. Keep Waco in court for the next twenty years defending itself.

Such abuse also tempts Federal scrutiny with its inevitable chilling effects. If Texas is going to be yeehawing, it had better watch out how and for what it does so, because there is an entity larger than it which WILL mess with it and knock those cowboys off their saddles. And they will sooner or later be missing the flexibility they will lose thereby.

The civil suits against Waco need to be so severe that no ignorant prosecutor or PD will even think about doing something like this in the future. I guess since they managed to dodge Waco 1 they figured they could do it again. Sue them till they hemorrhage money from every orifice for the next 25 years.
