we need someone here to fully explain what happens from here. what is a recess appointment,will it happen can it be reversed,how soon by whom? I have already heard several explanations and we need to know which is which.
Recess appointment of SCOTUS judge is possible, but really frowned on by the Senate. Unlikely to happen. Requires a recess (of course), and the Senate is in one now, and likely will be at other times between now and next January. Any recess appointment expires with the expiration of this Congress, that is, in January of next year.
He (the President) shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.
The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.The Senate doesn't have to recess until after the new President and Congress are sworn in.
The Constitution provides for a way to limit the powers of the president for a reason. The Founders didn't want a king, and they read about Julius Caesar's rise to power under the Roman Republic. It is up to Congress to use their Constitutional authority when necessary.
The Republicans can do that, even with an opposition party press trying to beat them with false outrage.
