It will be interesting to see what he tries. His normal instinct is to be confrontational and he may think selecting a minimally-qualified person that appeals to a part of his base (like he did with Sotomayor and Kagan, to appeal to Hispanics and lesbians) will fire up Democrats in the election, especially if the Republicans delay a vote. But that would remind the Republican base of the stakes involved in this election. So maybe he will go for a stealth nominee (on the surface well-qualified and not partisan, but a reliable vote for the Left once on the Court).
But Valerie may dictate to him that Kamala Harris must be the nominee.

I can’t argue with any of that. Good analysis, I’d say.

Ginsburg was born in 1933. At some point she will leave the Court. If a Republican is President at the time, it would be a chance to create a nominal conservative majority (as we supposedly had until Scalia died—in practice 4 liberals, 3 conservatives, 2 moderates who sometimes voted with the conservatives).

Is a recess appointment likely? Congress currently in recess.

The Senate Republicans will roll over, expose their genitals, and piss all over themselves.

This Senate already approved Loretta Lynch as AG 56-43.
So it seems like a no-brainer for Caliph Baraq to appoint her to SCOTUS.
The MSM screams to install her would be impossible to resist.
