What he says amounts to: She has not been convicted in a court of law, so she has not committed a crime, yet, that we know of.

He does not once mention that the leaks point toward numerous crimes, and his claim that we have not seen many prosecutions for this sort of behavior is whistling past the graveyard.

The main point that he seems to be making is that Hillary made a mistake because she got caught.

Dear Dan: if she’s innocent why is her alibi constantly changing?

The guy or guys who cut and paste the classified onto unclassified messages...are guilty of a number of crimes and probably will face at least ten to twenty years in prison.

Hillary should worry because if her messages went into a folder at the Clinton Foundation where Sid relayed them onto various ‘clients’....then that’s selling classified information (she is the one who told the State Department idiot to cut and paste.....so she knew it was classified. For that, you’d get ten to twenty years. It’s a question of if the FBI is willing to go walk into the Clinton Foundation and ask for a ton of information. On this part, it’d take at least two or three years to build a case from scratch.

It would be a tweener.......had the data on her computer only been unclassified, because she would have been in conflict with the federal regulations on archiving records.

When in the course of being investigated you erase half the evidence, and still don't manage to erase 1500+ emails containing classified information, you have a big problem. She was ultimately responsible for all the classified data for her department, yet was undermining all the safeguards for handling that data. That is definitely illegal.
