After a four-year battle with Alzheimer’s, Donna Lou Rayhons died in a nursing home in August, just four days shy of her 79th birthday. A week later, Henry Rayhons was arrested and charged with sexual abuse. State prosecutors accused him of having sex with his wife while she was incapacitated by dementia.

Does this mean that underage children, who are incapable of consent, will continue to be protected by the law? Subject expert Barbara Dafoe Whitehead calls this issue Traumatic Early Sexualization: The younger a child is sexually initiated, the more likely it is that force will have been used by the older child or adult, the compulsion blurring the dubious distinction between Statutory and Actual rape. This case has the potential to imply that the pink mafia's pecadillo for younger Partners is potentially criminal! This is the subject for the next After the Ball manifesto.

I have had a lot of experience with AD. There are sometimes flashes of “sanity” very late in the process. I am not saying this guy isn’t a weirdo, but if I were on the jury I would probably want to hear a lot more before convicting this guy.

I would bet he’s not all their either. The stress of that horrible disease is punishment enough for any caregiver.

All that will be needed in the court will be the reciting of their marriage vows.

“to have and to hold”..”In sickness and in health” .. “As long as you both shall live..”

That was her and his consent....

But today, in the eyes of the world these words no monger mean anything..

My Wife wrote a note and signed it,

” I hereby give permission for my husband to have sex with me if I am in a Coma or incapacitated and unable to express my wishes”

I keep it in my wallet.

I agree. My aunt died from AD a year ago and it’s far worse a disease, especially emotionally for family and friends.

I don’t know the details of this case, but if he didn’t harm her, I don’t think it should be the State’s decision. Was she pushing him away? Was she hurt? Or did the State interfere because it could?

Stupid.

How does the court know which time they were having sex that she was fully incapacitated amd unable to consent?

Further, what if she had prior given such consent in the event of her being taken over by dementia?

I mean, people make decisions all the time about their “Directives” even when something simple would save their life.

Treading into very murky waters here. When is mental incapacity of such a degree that attempted sex becomes assault? Were that an acceptable premise, what is the dividing line between “consent” and “assault”?

People do not stop thinking about sex because most of their cognitive abilities have diminished or largely disappeared. That DRIVE exists at a much deeper level than the human forebrain, and it has little to do with any inclination toward procreation or even loving feelings. Both those concepts come at a much later point in the upward evolution of the brain functions.

It does sound like she had a bad case of Alzheimer's. But one thing that comes to mind is that the woman must have had lucid moments or why would her daughter take her to lunch in the first place. She must have thought her mother was in her right mind when she first picked her up.

The government that agreed to get out of the bedroom of “alternative couples” has hypocritically gotten into the bedroom of the married. According to the referenced site, this began in Iowa about 25 years ago.

It’s both grim and sad, but to avoid being overzealously prosecuted for what used to be universally understood as a prerogative of marriage, it may help to see an attorney who knows the field. At the least I’d get it witnessed and notarized, and the attorney would know more.

Maybe she should think of America rather than of England? (duck’n & runn’n)

Poignant and accurate, Lt. My late wife and I enjoyed our last encounter shortly before she went (willingly) into a nursing home. Thereafter, I said no. She had regressed to pre-puberty emotionally, and I couldn’t handle it. We still cuddled, though.
